We have an amazing opportunity for a privacy lawyer to join Elastic's Global Data Privacy team. The data privacy counsel will make a contribution to the company's continued growth and success by acting as a legal counsel for data protection and privacy related issues. This attorney will be based remotely and will report to Elastic's Senior privacy counsel.

Responsibilities

  • Support complex, strategic commercial transactions involving data protection terms, including reviewing and negotiating customer and vendor DPAs, with emphasis on CCPA, state laws, GDPR and new standard contractual clauses.
  • Complete and review impact assessments, vendor questionnaires, records of processing activities, subject access requests, and similar privacy compliance documentation.
  • Assist the privacy team with review of data use cases by Elastic's business teams, including marketing initiatives, GDPR requirements, cookie compliance, as well as country specific compliance requirements.
  • Operationalize privacy law requirements by creating measurable tools, procedures, and processes for our Commercial and Operational teams to follow in order to implement compliance; collaborate with internal partners to understand their needs in creating such tools and empower their business goals while maintaining legal compliance.
  • Apply a risk-based approach to data protection reviews and guidance consistent with the Global Privacy Team's compliance regime.
  • Build strong internal and external relationships promoting privacy compliance and business enablement.
  • Help ensure adherence to global data protection and security laws, while enabling the development and execution of business initiatives.
  • Perform other legal responsibilities as requested, including building operational, scalable processes and tracking privacy team metrics.

Minimum Requirements

  • Top credentials and qualified to practice law in US or UK (or in-house equivalent); JD degree (or UK equivalent)
  • Proven experience in representing technology clients in matters in the US and the EU; in-house experience strongly preferred
  • Significant transaction experience with fast paced technology companies negotiating data protection agreements including DPAs for customers and vendors; understanding of underlying DPA

Obligations

  • Strong experience advising on GDPR requirements, with emphasis on use of EU data in a variety of complex marketing scenarios; must have a solid understanding of the new Standard Contractual Clauses and underlying vendor assessment requirements
  • Validated ability to execute tasks and ability to quickly pivot among multiple projects
  • Experience in a fast-paced environment, proven experience creating data privacy operational tools and processes for internal teams
  • Experience performing privacy operations including Records of Processing Activities, Data Protection Impact Assessments, data mapping and manual program tools
  • Effective listener with excellent communication skills: experience communicating complex information in simple easy to understand tools, visual guides and work flow diagrams
  • Understanding of IT/Security infrastructure, network architecture and SaaS computing, and data analytics
