Job Description

Lead attorney for Olympus' medical sales business units. Responsible for advising and liaising with senior executives with respect to healthcare fraud and abuse, compliance and transactional matters, and spearheading major initiatives. Other responsibilities include serving as a member of business executive committees; supervising sales and marketing program development; supporting outside counsel engagements; developing policy and procedure to control major risk areas; supervising paralegals and administrative staff; maintaining Olympus' overall risk profile and ethical standards; and leading and developing a team of lawyers and paralegals supporting the business.

Job Duties

  • Serve as principal legal advisor for certain Olympus medical sales business units providing advice on a broad range of topics including commercial transactions healthcare fraud and abuse compliance and regulatory and quality issues.


  • Provide guidance on risks and best practices related to Anti- Kickback Statute, False Claims Act, Physician Payments Sunshine Act and Food Drug and Cosmetic Act.


  • Supervise contract negotiation and drafting processes and performing negotiation and drafting as required for a variety of commercial transactions.


  • Ensure optimized process for legal review of commercial transactions.


  • Provide support in establishing and documenting sales programs and promotions.


  • Actively communicate with the Olympus General Counsel and members of the OCA Legal Department regarding material risks.


  • Implement and deliver training to sales business units regarding material legal updates.


  • Contribute to development of company and department policies and standards.


  • Supervise and lead personnel, including attorneys and paralegal staff.


  • Proactively identify legal risks affecting Olympus and collaborate with senior management to mitigate risks.


  • Follow and advise on major developments in laws and regulations.

Job Requirements

REQUIRED QUALIFICATIONS

  • J.D. Degree from an accredited law school.


  • Licensed to practice law; Pennsylvania or Massachusetts State Bar membership a plus.


  • Minimum of 10 years of experience at law firm or in-house legal function at mid-to-large size company required.


PREFERRED QUALIFICATIONS

  • Experience in highly regulated industry, including medical device, pharmaceutical, or life sciences preferred.


  • Excellent written and verbal communication skills.


  • Ability to manage outside counsel in both a time and cost- efficient manner.


  • Expertise with the relevant legal and regulatory landscape, including, but not limited to fraud and abuse laws, (Anti-Kickback Statute, False Claims Act), FDA regulation (Food, Drug & Cosmetic Act), privacy (HIPAA), anti-corruption (Foreign Corrupt Practices Act), and financial transparency (Physician Payments Sunshine Act).


  • Transactional experience negotiating agreements with stakeholders across the healthcare value chain including academic medical centers, GPO/IDNs, health systems, hospitals, integrated care organizations.


  • Experience operating in a rapidly evolving environment with limited direction, driving several projects simultaneously and managing high volume of requests


  • Experience working effectively with large, complex organizations and collaborating with cross-functional


  • Ability to influence, challenge and motivate others with a collegial and engaging style
