The Office of General Counsel, Driver License Legal Section is responsible for defending the Department's administrative actions in driver license appeals to the circuit courts and regulatory actions involving third-party administrators of driver license examinations, driver improvement schools, DUI programs, and ignition interlock device installers. The section also advises members of the Division of Motorist Services on issues related to the issuance, cancelation, suspension, revocation, or disqualification of driver licenses and state identification cards.

Total Compensation Statement

Your Benefits are a significant part of your state compensation. The total compensation package could be anywhere from $84,239 to $96,190 annually. The total compensation package includes annual salary, insurance, retirement, leave and holidays.

What will I be doing?

This Assistant General Counsel position reports directly to the Chief Counsel of Drivers license. As the Assistant General Counsel, you will represent the Department in trial and appellate work in civil and administrative cases, including the Division of Administrative Hearings (DOAH). This position will be responsible for preparing pleadings, briefs, and attending oral arguments incidental to these cases. This position also prepares responses to petitions for certiorari and other court actions, and handles any appeals generated from such petitions.

What Do I Need To Succeed In This Job?
  • Proficiency in civil, appellate, and administrative litigation.
  • Excellent writing and communication skills.
  • Knowledge of Florida Statutes, Florida Administrative Code, and Federal laws, rules, and regulations.
  • Ability to identify complex problems and review related information to develop and evaluate resolution options and implement solutions.
  • Ability to use relevant information and individual judgment to determine whether events or processes comply with laws, regulations, or standards.
What Are The Preferred Qualifications?

Preference Will Be Given To Applicants With The Following
  • At least two (2) years of litigation and appellate experience.
Assistant State Attorneys and Assistant Public Defenders are encouraged to apply.

What Are The Job-Related Requirements?
  • Must be a member of The Florida Bar in good standing.
  • Occasional overnight travel is required.
  • Selected applicant must possess a valid Class E or higher driver's license. A driver's license history review will be conducted on all candidates in consideration for the position.
  • This position is subject to a Level 2 background check, along with Criminal Justice Information System (CJIS) clearance, to include a fingerprint-based check of the criminal history records of the FBI, as a condition of employment pursuant to Chapter 10.1127, 435 and 943, Florida Statutes. As an applicant for positions requiring CJIS security clearance, you are required to disclose criminal records that have been sealed or expunged.

The elements of the selection process may include a skill assessment and/or oral interview.

Applicants being considered for employment will be required to submit to a fingerprint-based background investigation, which will include a check of the criminal history records of the FBI.
