What is it that we do at Colonial Pipeline Company?
Colonial Pipeline is the largest refined products pipeline in the United States, transporting more than 100 million gallons or 2.5 million barrels per day. Colonial transports various grades of gasoline, diesel fuel, home heating oil, jet fuel, and fuels for the U.S. military through a pipeline system. Colonial transports approximately 45 percent of all fuel consumed on the East Coast, providing refined products to more than 50 million Americans.
About the Senior Attorney, Real Estate Position
The Senior Attorney of Real Estate will be focused on providing legal support for real estate transactions and land management matters of a regulated refined petroleum products pipeline company, with an emphasis on support for right-of-way and pipeline relocation matters, particularly landowner engagement and negotiation. This position will engage with outside counsel and be responsible for guiding counsel in accordance with management team guidance and goals. The Senior Attorney will support M&A and other growth initiatives and will play an instrumental role in supporting the development and execution of the growth strategy at Colonial.
What You Get to Do:
  • Provide strategic counsel and advice and coordinate across the company on matters related to real estate, right of way and land management.
  • Review, draft and negotiate a broad range of real estate transactional documents, including access agreements, encroachment agreements, easements and right of way agreements, permits, license agreements, facility leases, real estate purchase and sale agreements, subordination agreements and deeds, ensuring the transactions are in compliance with legal and regulatory requirements as well as corporate objectives.
  • Interpret real estate instruments and provide legal opinions on prior rights and other property interests.
  • Collaborate and work closely with internal environmental counsel on property matters associated with environmental conditions.
  • Negotiate and provide strategic support for pipeline relocation projects with various federal, state, and local governments (including departments of transportation) as well as private landowners and developers and draft documents associated with those transactions.
  • Negotiate and resolve legal disputes related to real estate matters, including issues of trespass, facility relocation and landowner disputes, and draft settlement agreements associated with the same.
  • Negotiate, draft, and review real estate instruments associated with business development and growth projects such as leases, licenses, amendments, and other real estate and corporate related documents and agreements.
  • Engage with right-of-way and land management leadership to identify and assist in responding to emerging concerns, including development of relevant training materials.
What You Bring to the Table:
  • Juris Doctor degree from an accredited law school.
  • Ideally, 6+ years of experience working (either as external or in-house counsel) in transactional real estate, with particular focus on right-of-way and land management in the energy, utilities, refined products, liquefied natural gas, interstate natural gas, and/or crude industry.
  • Experience negotiating with various federal, state, and local governments (including departments of transportation) as well as private landowners and developers on real estate transactions.
  • Membership in good standing in a state bar association as an attorney qualified to practice law in that state, preferably Georgia.
  • Experience in acquiring, divesting, and modifying property rights is essential to this role, along with experience in related real estate matters, including survey and title, easements, access, encroachment, leases, purchase, and land swaps.
  • Knowledge of Real Property and Easement Law, and the ability to provide effective guidance as to interpretation, application, and effect of federal, state, and local law.

  • Experience reviewing, creating, and executing real estate documents is preferred.
  • In-house real estate transactions experience strongly preferred.
  • Experience with real estate transactions in the refined petroleum pipeline industry.
  • Experience working in or with the land department in the midstream or production sector of the petroleum industry.
  • Experience negotiating with various federal, state, and local governments (including departments of transportation) as well as private landowners and developers of real estate transactions.
  • Experience providing real estate transactional pipeline and storage support in various energy sectors (e.g., crude, natural gas, refined products)
  • Experience negotiating and resolving real estate and landowner disputes.
  • Preferred Certifications & Licensures: Certified Professional Landman (CPL), Registered Professional Landman (RPL), Registered Landman (RL), Certified Professional Lease and Title Analyst (CPLTA).
