You will will work within the legal organization to support a wide variety of marketing, e-commerce and digital activities with a particular focus on healthcare compliance issues.

What will you do?

The ideal candidate will be flexible, creative, and open to learning about issues that touch on eBusiness, digital, privacy, healthcare, and marketing. The Associate Contracts Counsel, Commercial Healthcare will help the marketing organization translate legal, healthcare, and compliance issues into real world applications.

What will you do?
  • Support a variety of businesses to build robust and innovative marketing programs while addressing a range of issues including healthcare compliance, various codes of conduct, and regulations, such as Anti-kickback laws and the Sunshine Act.
  • Evaluate marketing activities for privacy, marketing, healthcare, and other legal issues and provide practical feedback
  • Analyze risks of promotional programs and various marketing-related activities in order to safeguard the company’s reputation
  • Collaborate with the business on incentive programs, touching on issues of privacy, healthcare compliance, and ethical considerations
  • Help build SOPs and other written materials used to by the business to ensure appropriate implementation of legal recommendations
  • Provide practical, implementable legal advice to enable the marketing and eBusiness teams to effectively go to market while minimizing risk and compliance issues
Education/Experience
  • 5+ years’ experience in an organization with products or services that require handling issues related to medical devices or health care professionals
  • JD or equivalent legal qualification and admission to a state bar is required, or its equivalent in another country.
  • Familiarity with Anti-kickback laws, False Claims Act, Medicare/Medicaid issues, and associated regulations.
  • Familiarity with data privacy issues and digital issues are a plus.
  • Familiarity with concepts and regulations that apply to marketing technical and scientific products to business customers.

  • Able to grasp sophisticated issues, provide concrete advice, and work independently with limited oversight.
  • Excellent written communication skills and transparency with clients are required.
