What you’ll achieve

As a Global Health Information Privacy Counsel, you will be responsible for establishing and maintaining a consolidated health information privacy compliance program, including policies and practices, Business Associate Agreements, playbooks, training and related privacy and data protection contract term documentation. You will serve as a central escalation point for global contract managers and legal teams on complex privacy-related negotiations involving health information with third parties and customers, coordinating contract template or other updates in response to global laws and regulations and partner with individuals at all levels of the organization on health information privacy related initiatives. Reporting to Dell’s Senior Managing Director, Global Privacy Counsel, you will infuse Dell’s Privacy by Design approach in daily working practices and assist our legal department  in embedding privacy into any new Dell product, services, technology solution, system or process from inception. This will include ensuring that all contractual documents, related processes and deliverables are in accordance with Dell’s Code of Conduct, Privacy Policy, Procedures and Standards, applicable privacy laws and industry leading frameworks.

You will:

  • Collaborate with the Health Information Privacy Program Manager in designing, implementing, and maintaining Dell’s HIPAA / health information compliance program for Dell offerings to the healthcare sector
  • Serve as the central attorney for personal health information contract related escalations in collaboration with dedicated customer and procurement contract teams and legal stakeholders.
  • Review and coordinate updates to privacy terms relating to personal health information in all Business Associate Agreements (including but not limited to customers, partners, and subprocessors).
  • Maintain Business Associate Agreement playbooks for all contract teams, and contribute to product and service related or topic-based playbooks.
  • Coordinate global personal health information privacy related contract updates and related processes for term or other operational changes required by applicable laws or regulations (e.g., updates to HIPAA or comparable global, state or local laws).
  • Prepare and deliver communications/trainings concerning HIPAA compliance, protecting personal health information, and related topics.
  • Partner with Product Development as needed to ensure privacy by design with respect to personal health information.
  • and other customers to ensure Dell uses and protects health information in a lawful and ethical way.
  • Oversee regulatory compliance and notification requirements relating to health information, interact with regulators as needed.

Essential Requirements

  • Juris Doctorate and bar admission in good standing.
  • Exceptional leadership, time management, facilitation, organizational, drafting and negotiation skills.
  • Experience with supplier diligence and vendor privacy risk management relating to the use of personal health data, ability to manage contract escalations.
  • Deep working knowledge of HIPAA, US state healthcare and data protection laws, and equivalent global privacy laws (e.g., GDPR, PIPL, LGPD, PHIPA).
  • Experience establishing and maintaining  a health information privacy program.
  • Expertise in managing data incidents from discovery and mitigation through notice.
  • Technical expertise in issue spotting and risk mitigation relating to health information technologies and privacy risk management. 
  • Expertise collaborating with various subject matter experts to deliver on complex, cross-functional technical projects.
  • Fluent in terms of art relating to privacy, security, and health care.
  • Curious about the ethical use of data and passionate about ensuring privacy compliance across a large, complex organization through ongoing learning to stay apprised of the ever-changing privacy landscape.
  • Superior communication and emotional intelligence skills for interactions with internal and external stakeholders across all levels and departmental functions.

Desired Requirements

  • 5-8+ years of legal counsel experience working on varied privacy, data protection, and compliance activities in healthcare technology; in-house experience a plus.
  • IAPP CIPP/US certification is preferred.
  • HITRUST certification experience a plus.
