Job Description

The Associate General Counsel - Litigation maintains responsibility for managing and leading a broad range of litigation matters for the Company and its subsidiaries. This shall include reviewing and drafting pleadings, researching legal issues, developing litigation strategy and budgets, setting litigation reserves, responding to discovery requests, managing outside counsel, conducting internal investigations, responding to government inquiries, attending trials, issuing litigation holds, and otherwise leading the organization’s litigation portfolio.

Job Duties

Handle litigation matters arising from the daily business operations of the organization, including:


  • Managing all aspects of discovery such as responding to interrogatories, requests for documents, requests for admissions, deposition notices, and subpoenas.

  • Resolving pre-litigation disputes and settlements to avoid litigation, if possible.

  • Communicating with management on strategy and resolution of matters.

  • Issuing litigation holds and preservation instructions to internal personnel.

  • Drafting, reviewing and revising legal documents, pleadings, motions, and briefs.

  • Managing outside counsel and corresponding budgets and fees.

  • Preparing and conducting litigation related training.

  • Educating and counseling business colleagues on relevant litigation issues and assisting in the development and drafting of related policies and procedures as needed.

  • Conduct internal investigations and respond to government inquiries, as needed.

  • Assist the legal department in the development of best-in-class processes and procedures. Supervise professionals and/or paraprofessionals employed in the Legal Department.

  • Complete litigation related projects and perform other duties as assigned.

Job Requirements

REQUIRED QUALIFICATIONS:

  • J.D. Degree from an accredited law school.

  • Current membership in good standing with the Pennsylvania Bar Association or the bar association of another jurisdiction.

  • Eligibility to become a Registered In-House Counsel in Pennsylvania.

  • At least 8 years of litigation experience at a law firm and/or in-house at a mid-to-large size company.

  • Experience directly handling or managing litigation.


PREFERRED QUALIFICATIONS:


  • Demonstrated experience developing successful litigation strategy.

  • Ability to advise clients on a broad range of litigation matters.

  • Experience working in the medical device or healthcare industry.

  • Capable of effectively leading internal investigations.

  • Familiarity with healthcare law topics including regulatory, trade compliance (import/export control), Anti-Kickback Statute (“AKS”) and Foreign Corrupt Practices Act (“FCPA”).

  • Demonstrated litigation training and experience.

  • Strong leadership and relationship skills with demonstrated strategic decision-making.

  • High energy, self-motivated, hands-on approach with strong results-based mindset.

  • Excellent written and verbal communication skills with the ability to navigate both up and down the organization. Ability to closely manage outside counsel in both a timely and cost-efficient manner.

  • Exceptionally organized and prepared to work under pressure gracefully in a fast-paced, expanding and dynamic corporate environment.
