As part of the Red Bull Global Intellectual Property (IP) Team (which is based in Austria), the IP Attorney will deliver high- quality, commercially–oriented IP services to Red Bull GmbH and its American Subsidiaries. Red Bull GmbH, the owner of all Red Bull trademarks worldwide, handles and coordinates all IP matters for all of its wholly owned subsidiaries and distributors in over 160 countries. The IP Attorney will help support the IP needs for all of the Americas (from Canada to South America) and work closely with the VP of IP for The Americas, local counsel, Red Bull employees and third parties (such as investigation firms and infringers). The position will be based out of Santa Monica.

PRE-LITIGATION/UNFAIR COMPETITION

Assist with and handle enforcement matters such as investigations, researching infringements, recommending matters to take action on, providing risk assessments, reviewing Watch Notices, conducting website takedowns, drafting C&D letters, reaching out to infringers and other pre-litigation enforcement measures
LITIGATION AND OTHER CONFLICT MATTERS

Assist with and handle trademark oppositions, cancellations, litigation and other conflict matters in The Americas
TRADEMARK-RELATED DOCUMENTS

Draft IP licenses, releases, co-existence agreements, settlement agreements, as well as advise on IP language within other commercial agreements.
TRAINING & COMUNICATION

Train Customs personnel on Red Bull’s IP rights

Provide IP advice to and prepare presentations for IP Team and other Red Bull departments

Communicate with outside counsel and infringers

EXPERIENCE

Your areas of knowledge and expertise

that matter most for this role:
  • 6-8 years of IP law experience with a strong background in US trademark law and brand enforcement. Law firm or in-house experience with large volume of trademark disputes. Excellent communication, interpersonal and writing skills. Sound computer skills including trademark maintenance database software (e.g., DIAMS), Word, PPT, Excel.
  • The successful candidate must exercise sound judgment, be able to work independently and efficiently under time pressure and deadlines, have strong project management skills, and be professional, proactive, and enthusiastic. Trademark litigation experience strongly preferred
  • Experience drafting trademark-related contractual documents such as co-existence and settlement agreements, and licenses preferred. Fluency in Spanish and/or Portuguese is a plus.
  • Experience in intellectual property law in South/Central America is a plus. Experience managing a team is a plus.
  • Juris Doctor and bar admission (or equivalent in your jurisdiction)
  • Fluent in English, Spanish or Portuguese a plus
  • Travel up to 10%
