Intellectual Property (IP) Attorney

Location: Remote – United States

When we invent something new, this team provides legal opinions and analysis on its patentability. They handle legal projects relating to all kinds of issues – from copyrights to trade secrets, licensing agreements to the IP aspects of contracts. What’s more, they advise or coordinate with external counsel on legal issues ranging from regulatory compliance to data privacy and risk mitigation. Crucially, they prepare and present applications for patents, copyrights and trademarks. They are our IP guardians.

What you’ll achieve

As an Intellectual Property Legal Counsel, you will be responsible for providing a full range of intellectual property legal support including, open source reviews, standards issues, patent preparation and prosecution, patent portfolio development, freedom-to-operate analysis, rendering opinions, managing outside counsel, drafting and negotiating licenses, development and research collaboration agreements, and due diligence support for business development and counselling client.

You will:

• Regularly make presentations and interact with the business with regard to intellectual property legal matters including patents, open source and standards
• Provide a full range of support functions related to open source software, including vetting proposals to use open source software and to contribute to and/or create open source projects, and helping to develop and enforce open source policies for the company

Essential Requirements

• Juris Doctorate (JD), admission to practice before the USPTO and licensed to practice in at least one state are required; undergraduate or advanced degree in Electrical/Computer Engineering, Computer Science or related field is required
• 5+ years of law firm or corporate law department experience is required, and a mix of both types of experience is preferred
• A demonstrated background in the computer and software arts, including drafting and prosecution of patent applications in the computer and software arts, is required
• Experience in the rendering of patentability and non-infringement opinions is required
• Ability to articulate and communicate with and positively engage their clients is required; ust be able give well organized, thoughtful presentations to upper management

Desirable Requirements

• Experience in due diligence activities is preferred
• Experience in technology license drafting and negotiation is preferred
• Experience in providing legal support for open source software and standards organizations is preferred
