Duties Description
The Assistant Counsel, NS=M5, functioning as the Managing Attorney in the Office of General Counsel will manage and supervise a team of between 5-7 attorneys within the Office of General Counsel that primarily appear before the Commission in the role of administrative litigants representing the Department of Public Service in rate cases filed by utilities doing business in the State. The appointee will be responsible for supervising the work of each of the attorneys, and otherwise report directly to the General Counsel regarding pending rate cases and related matters assigned to the unit. The candidate will also perform additional duties, including but not limited to:
  • Researching and interpreting complex areas of regulatory law, Commission decisions and business, as well as economic policies.
  • Working with other offices at the Department generally in the context of rate cases.
  • Ensuring that all Commission processes are carried out lawfully in conformance with the procedural requirements of the Public Service Law, the State Administrative Procedure Act, the State Environmental Quality Review Act, and the Public Officers Law.
  • Drafting orders and other documents to effectuate Commission decisions.
  • Leading staff preparation and presentations in Commission proceedings set for hearings, negotiations, and alternative dispute resolution.
  • Representing and participating as the Department's advocacy staff in administrative proceedings before the Commission, and in settlement discussions.
  • Coordinating the development and adoption of Commission rules and policy statements; and otherwise participating in staff team efforts apart from administrative proceedings.
Additional Comments

Salary will be commensurate with experience. The primary location for this position is Albany, NY with up to 15% travel. This is an appointment to a position in the exempt jurisdictional class. As such, the incumbent of this position would serve at the pleasure of the appointing authority. Appointment to this position is contingent upon Division of Budget approval.
