Financial Crimes Attorney, AML Advisory

The Financial Crimes Attorney will be based in the United States and provide legal advice to all control function and front line business partners regarding all aspects of Anti Money Laundering laws, including the Bank Secrecy Act, Patriot Act, and AML Act of 2020, and all AML regulations promulgated by FinCEN, the OCC, Finra, the SEC and other agencies in support of responsible growth risk decisions about clients, prospects, transactions, third-party arrangements, new products or services, and the execution of BofA’s AML Program. The position also involves the provision of AML legal subject-matter expertise in support of select investigations, regulatory reporting, information sharing, utilities, and regulatory examination issues, and provides legal support as needed for AML issues arising in Asia Pacific region and occasional backup support for economic sanctions globally. This position is for a regulatory attorney with expertise in AML legal issues; the position does not involve managing investigations or enforcement matters.
To successfully perform in the role, the attorney will:
- Collaborate with teammates, including other members of the financial crimes and sanctions legal team, compliance and risk partners, and front line business teammates, and deliver timely, accurate, practical, and actionable legal advice to enable business, risk, and compliance partners to make appropriate risk-based decisions.
- Promote a strong risk-management culture and encourage the timely identification, escalation, and mitigation of risks consistent with the Legal Department’s Vision Statement supporting the company’s responsible growth strategy.
- Participate as needed in teleconferences with teammates in all of the countries, regions, and time zones in which Bank of America conducts business.
- Reliably and effectively advise senior executives.
- Manage outside counsel as needed and consistent with the company’s expense management goals
REQUIRED SKILLS AND EXPERIENCE:
- A J.D. degree and admission to at least one state bar.
- A minimum of six to eight years of pertinent prior legal experience is required.
- Subject-matter expertise and demonstrable experience analyzing and providing legal advice about U.S. Anti Money Laundering laws and regulations as they relate to financial institutions,
- Ability to present complex issues clearly and concisely verbally and in writing and provide succinct action-oriented legal advice. Independent, organized, self starter capable of prioritizing conflicting demands and handling multiple issues simultaneously.
DESIRED SKILLS AND EXPERIENCE:
- Experience providing legal advice to or within a financial institution.
- Knowledge of and experience providing legal advice relating to a large financial institution's AML Program, including with respect to its customer identification and due diligence requirements and suspicious activity reporting.
- Experience providing legal advice relating to economic sanctions,
- Familiarity with complex international commercial payments solutions, debt and equity capital markets, and consumer retail banking products such as credit and debit card and international wire transactions.
