Overview

Capital One’s Legal Department is looking for a talented, highly motivated and dynamic Intellectual Property (IP) attorney to lead an industry leading team. The Senior Director will report to our Managing Vice-President, Chief Counsel - Enterprise Innovation. Our Intellectual Property team supports our national Brand and Brand strategy and is an industry leading patent program  working to further develop and implement an enterprise-wide patent strategy and cultivate our culture of inventor engagement and excitement. We are looking for someone with the following experience and skills: 

  • Ability to develop and drive IP strategy in line with the enterprise business goals

  • Can lead a highly talented team of IP professionals and help guide a well established program 

  • Is a registered patent attorney with experience in preparing and prosecuting software or electrical applications; the successful candidate will be responsible for protecting Capital One’s inventions and continuing to shape Capital One’s enterprise-wide patent strategy.

  • Counsel and provide strategic oversight of Trademark advice and support of Brand organization

  • Counsel and advise Artificial Intelligence and Machine Learning product, engineering, and design teams

  • Independently counsels clients and provides practical legal advice on a wide range of patent-related issues, including advising on matters related to litigation

  • Creates friendly and collaborative working relationships, particularly with their teammates, the rest of the legal department, internal clients, and outside counsel. A good sense of humor and an interest in having fun at work are pluses

  • Brings demonstrated experience in drafting and negotiating complex intellectual property transactions, including drafting and negotiating joint development agreements, patent pool and standards agreements, NDAs, and university collaboration agreements

  • Understanding of artificial intelligence and machine learning principles associated with responsible AI

  • Possesses executive communication, analytical, negotiation and organizational skills

 

Responsibilities Include: 

  • Utilizing prior experience to structure, draft, and negotiate IP agreements related to commercial and technology transactions, including IP licenses, joint development agreements, patent pool and standards agreements, NDAs, university collaboration agreements, product development agreements, software-as-a-service agreements, software licenses, partnership agreements, supply agreements, manufacturing agreements, and developer agreements

  • Managing a team of 6 to 10 members by leading and fostering an environment of trust, collaboration and belonging as well as developing, challenging, and coaching team to reach their goals

  • Providing strategic business and legal advice to develop a comprehensive, long-term approach to our intellectual property rights, open source licensing and machine learning 

  • Identifying IP issues in complex mergers, acquisitions, and divestitures, and advising the business on IP aspects of these deals from conception to closing

  • Proactively engaging various teams across the enterprise to identify potential IP risks and provide education and training to technical teams

  • Presenting in front of stakeholders and communicating complex legal concepts in a clear and simple way that fosters trust and respect

  • Demonstrating sound judgment even in novel situations, and understand business goals in a way that helps the business evaluate risk effectively and provide practical legal advice

 

Basic Qualifications: 

  • Juris Doctor from an accredited law school

  • Active member in good standing of at least one state bar

  • At least 7 years of experience providing counseling for intellectual property transactions

  • At least 3 years of experience in People Management

  • Registered to practice before the US Patent and Trademark Office 

 

Preferred Qualifications: 

  • Experience with IP issues in open source, including the IP impact of open source contributions and familiarity with widely used open source licenses

  • Experience providing IP transactional support related to patent sales and licensing

  • Experience with identifying legal issues associated with the development of machine learning models and algorithms
