Employment and Labor Counsel
What is the role
As an Employment and Labor Counsel, you will be responsible of the following duties:
Providing proactive legal services and comprehensive advice and counsel regarding US labor and employment laws to a wide range of stakeholders across diverse business and functional lines
Partnering with the Human Resources Department of Shell USA, Inc., to support businesses and functions in the United States, such as Downstream, Upstream, Integrated Gas, Projects & Technology, Renewables & Energy Solutions, Global Functions, US Policy, MA&D, Employee Relations, and Industrial Relations
You will be reporting to the Managing Counsel – North America Labor, Employment & Benefits
Acting as the primary legal advisor on confidential employment matters, appropriately challenging business proposals and decisions by identifying potential legal risk and drawing attention to reputational exposure
Thriving in a fast-paced work environment and managing competing priorities with resilience will be key to success in this role
What we need from you
You must have legal authorization to work in the USA on a full-time basis for anyone other than current employer
You must have approximately (3 - 6) three to six years of experience as an attorney, specifically in US labor and employment law
Juris Doctor Degree in Law and licensed to practice law in Texas, or able to obtain license in a reasonable timeframe
Experience providing advice and counsel regarding employment matters, policies, and processes that impact diverse businesses and jurisdictions throughout the US
You must have an experience with employee investigations, employment litigation, and dispute resolution; experience handling first-chair employment mediations is not a requirement but is considered a plus
Familiarity with federal and state regulatory agencies, including the DOL (Department of Labor), EEOC (Equal Employment Opportunity Commission), IRS (Internal Revenue Service), TWC Texas Workforce Commission), NLRB (National Labor Relations Board), and SEC (Securities and Exchange Commission)
Experience with business transactions, including advising on employment matters relating to mergers, acquisitions, and divestments is not a requirement but is considered a plus
Experience with traditional labor law and the delivery of advice and counsel for a unionized workforce is not a requirement but is considered a plus
You must have the ability to work independently without the assistance of outside counsel, to answer complex legal questions and to see both the big picture and to handle details accurately and consistently
Confident and credible with strong interpersonal, influencing, and negotiating skills
Ability to provide value-added and proactive legal services
Demonstrated ability to clearly explain legal risks and develop sound mitigation strategies
Makes professional judgement as to when to refer decisions / issues to line manager
Consults and keeps line manager informed at significant checkpoints
Has considerable professional autonomy and will consult with line manager only on more significant, novel or material legal or risk issues and decisions
Ability to establish targeted and sustainable relationships with key stakeholders
Ability to meet deadlines and demonstrate flexibility
Excellent analytical and organizational skills and legal drafting skills
Possessing a high sense of professionalism, highest level of integrity, and ability to maintain confidentiality of sensitive information
Fluent in speaking, writing, and reading in English
You must be flexible to travel as needed
