We are currently hiring a Director, Senior Legal Counsel, Marketing (an expert marketing and ad/promo attorney) at our Forth Worth, TX location. Join a fun, cohesive, and hard-working legal team, that together, support the marketing and brand activity of Alcon. This position offers the opportunity to work closely with the many different business teams across the organization including interacting with colleagues in Alcon’s legal, compliance, privacy, marketing, R&D, medical, regulatory, commercial, and technology functions. Director, Senior Legal Counsel, Marketing is part of the North America and Global Franchise Legal Team within the Legal & Compliance function and works under the direction of the Head, Legal, US and Global Vision Care Franchise.

Key Responsibilities:

  • Serve as a primary legal point of contact for Alcon’s marketing teams
  • Review and advise on customer- and consumer-facing sales, marketing and promotional materials.
  • Partner with internal marketing and communications teams to counsel and advise on marketing and promotional content on various mediums, including websites, online campaigns, press releases and on social media.
  • Evaluate claims, claim support strategies, campaigns and programs to ensure compliance with applicable laws. Identify legal and reputational risks in proposed advertising.
  • Manage review, drafting, and negotiation of marketing-related contracts.
  • Provide legal counseling to marketing and other cross-functional partners to support social and digital media activities, including issues relating to influencer marketing and compliance with all FTC, FDA, state and other relevant advertising regulations and guidelines.
  • Manage inquiries and challenges from state and federal agencies, as well as competitors regarding product claims and advertising.
  • Evaluate and advise on competitor marketing and promotional activities, including competitive product claims.
  • Manage defense of lawsuits related to product claims and advertising with outside counsel.
  • Quickly and accurately identify, communicate, and devise appropriate mitigation strategies on legal risks as they apply to Alcon’s marketing and promotional strategy and initiatives.
  • Build and maintain collaborative relationships across Alcon functions including with the Legal & Compliance teams, R&D, Medical Affairs, Finance, Regulatory and Market Access and other global colleagues.
  • Be responsible for training, education and raising awareness for legal and compliance for marketing teams and do so in an innovative and engaging way.
  • Perform such other tasks and responsibilities as may be assigned by the Head, Legal, US and Global Vision Care Franchise

Key Requirements/Minimum Qualifications:

  • Bachelor of Law/Juris Doctorate
  • The ability to fluently read, write, understand, and communicate in English
  • 10 Years of Relevant Experience
  • Work hours: Standard, Monday - Friday
  • Travel Requirements: Up to 10% Domestic and International

Preferred Skills and Experience:

  • 8+ years of directly related advertising, marketing and business law experience, relevant in-house experience with a large organization in the medical device or other healthcare industry preferred.
  • Experience reviewing and advising on marketing and advertising content.
  • Ability to provide concise, contextually nuanced, and actionable feedback.
  • Ability to recognize when to elevate matters to senior leadership.
  • Strong knowledge of healthcare regulations (including familiarity and experience advising with regard to anti-kickback statutes and FDA requirements) and FTC rules and regulations.
  • Must have good business acumen and be solution and customer oriented.
  • Ability to collaborate across the organization to appropriately identify, communicate, and mitigate legal and compliance risks.
