Our Legal Innovation & Technology (LIT) group within the law department at Marsh McLennan is looking for a Discovery and Information Governance Counsel to join the team. You will play a critical role in the success of our in-house law department, as you optimize Discovery processes, innovate with legal technology and strengthen legal service provider relationships.
As the Discovery & Information Governance Counsel, you will play a crucial role in streamlining the company’s Discovery processes and strategies and driving the technological transformation of the law department. As part of this role, you will focus on strengthening relationships and programs with the department's internal partners across the company and external legal service provider, including technology companies, service providers and law firms. You will ensure the mitigation of risks through industry best practices, and technological innovation to help the law department work smarter, better and more joyfully.
In this role, you will report to the Chief Legal Innovation Counsel in the Legal, Compliance & Public Affairs (LCPA) department.

We will count on you to drive excellence in the following areas:
Discovery Strategy & Optimization
- Develop and implement Discovery strategies and best practices to streamline the identification, preservation, collection, processing, review, and production of electronically stored information (ESI) across the organization.
- Collaborate with in-house legal and external counsel to assess Discovery requirements for each matter and scope projects accordingly.
- Coordinate and oversee the Discovery process, managing the data quality control and workflow to external Discovery service providers.
- Communicate project activities with all internal and external teams. Regularly seek actionable feedback from stakeholders.
- Develop and maintain Discovery protocol documentation, metrics and detailed tracking information.
Legal Technology Management
- Partner with in-house counsel, service providers, outside counsel, and corporate IT to create, oversee, and support the development and implementation of Legal technology strategies and solutions. Evaluate, select, implement, and maintain industry leading technology tools, platforms, and systems.
- Provide guidance to legal teams, ensuring efficient utilization of technology for varied department needs (e.g., data identification, collection, search data analysis and visualization, and document review).
- Educate legal teams on the effective use of tools and technologies, through a variety of live and asynchronous training methods.
- Follow industry trends and emerging technologies to enhance capabilities and optimize processes.
Discovery Resource & Spend Management
- Recommend appropriate resource plans for matters, including distribution of work across legal service providers, including law firms and vendors, and identify opportunities to manage legal service provider spend through fixed or alternative fee arrangements.
- Establish and maintain strong relationships with legal service providers, negotiate contracts, and ensure compliance with established service level agreements (SLAs) and quality standards.
- Enhance Outside Counsel Discovery Guidelines and policies for managing outside counsel spend.
- Collaborate with stakeholders to implement budget forecasting and reporting tools to manage and control discovery costs.
- Identify opportunities to optimize outside counsel spend, negotiate alternative fee arrangements, and drive cost-effective strategies such as volume discounts.
- Manage legal service provider performance, monitor project timelines, and conduct regular checks to ensure adherence to established playbooks and protocols.
- Collaborate with legal service providers to resolve technical issues, troubleshoot challenges, and improve workflow efficiency.
Information Governance
- Develop and advise on policies related to sound information governance at an enterprise level, working closely with key stakeholders around the company, including IT.
- Work closely with cross-functional team to provide guidance on optimal strategy and policy around information governance considerations, specifically from the perspective of ensuring compliance with discovery requirements.
- Provide legal input into enterprise retention schedules with various teams around the company to facilitate ongoing maintenance and accessibility of final requirements.
What you need to have:
- A JD degree and licensed to practice in the United States
- A minimum of five (5) years in a Discovery or Information Governance role, at a law firm, in-house legal department, or legal service provider.

- Deep domain expertise in legal and regulatory requirements governing Discovery, cross-border data transfers, and information governance.
- Experience with designing and deploying legal hold processes, data collection techniques, data analytics, and data management systems.
- In-depth knowledge of Discovery software, platforms, and methodologies, including data processing, document review, and production.
- Strong experience with document review technologies and strategies, including Early Case Assessment, advanced analytics and Technology Assisted Review.
- Information governance experience, including in the areas of information management, retention and protection laws, regulations, and best practices, as well as emerging trends.

The applicable base salary range for this role is $156,100 to $312,000.
The base pay offered will be determined on factors such as experience, skills, training, location, certifications, education, and any applicable minimum wage requirements. Decisions will be determined on a case-by-case basis. In addition to the base salary, this position may be eligible for performance-based incentives.
