Position Purpose
In this key role, you will report directly to the General Counsel and will provide advanced legal, compliance, and insurance support to the various RESICAP business units.
Job Responsibilities
50% Compliance & 50% Legal and Insurance
- Assist General Counsel in providing day-to-day advice and strategic planning on real estate legal matters.
- Provide oversight of real estate litigation matters and manage the resolution of pre-litigation claims including rigorous oversight of outside counsel to ensure quality work product and budgetary compliance.
- Draft and negotiate a wide range of transaction documents related to RESICAP's purchase of residential property portfolios, individual properties, and related management agreements.
- Advise on other general corporate matters and review agreements including NDAs, leases, client contracts, vendor agreements and corporate organizational documents.
- Identify opportunities to improve legal processes and operations.
- Maintain a risk and control matrix for applicable state and federal laws and regulations having compliance components as they relate to RESICAP's operations.
- Become an expert on all federal, state and local laws, rules and regulations that pertain to real estate transactions (especially foreclosure sales), REO asset management, employment and labor, as well as providing strategic thinking about how best to remain in compliance while moving the business forward.
- Develop a matrix that includes all client-specific contractual obligations and risks.
- Assist with preparation of quarterly and ad hoc compliance reporting on risks and remediation.
- Assist managing the corporate insurance program at RESICAP including interacting with brokers, establishing a renewal strategy, requesting certificates of insurance and surety bonds, managing insurable claims, providing guidance/confirmation of coverage for client RFP’s, policy management, etc.
- Oversee the procurement and maintenance of flood, hazard and general liability insurance for RESICAP's investment assets (i.e., single and multi-family dwellings).
Job Requirements ( Including Education)
- Position requires a four-year college degree with a minimum of five (5) years of relevant experience (or two (2) years with a Juris doctorate).
- Must have strong organizational, interpersonal, analytical, drafting, negotiation and communication skills
- The ability to manage demands appropriately, work in a fast-paced environment and to prioritize multiple matters.
- Additionally, must have initiative and ability to work autonomously.
- Hybrid allowed from the start (3 days in office, 2 remote)
