Job Family Summary

The Litigation Services Attorney job family is responsible for managing Insurance Defense and other Litigation / Disputes work 

Job Summary:

Represents the Company in Special Investigations/Litigation to counter fraud against the company on No-Fault and related matters. Filing of affirmative litigation in both state and federal courts. Prepares for and conducts EUOs, hearings, trials, arbitrations, mediations, depositions, and trials. Prepare and argue pre and post-trial motions, and prepares for/attends all court conferences and hearings. Provides project management, coordination, and collaboration between legal teams within Law and Regulation with business clients.  Conducts research, substantive drafting, reviewing, advising, and negotiating for more complex matters.  

Key Responsibilities:

 

  • Prepare affirmative litigation in Federal and State Courts
  • Review file assignments prepare pleadings, propound discovery, gather evidence, strategize for resolution
  • Partners with clients to develop handle all facets of discovery and trial preparation
  • Review and gather documentary evidence
  • Prepare witnesses and clients  for depositions, arbitrations, mediations and trials including expert witnesses 
  • Conduct depositions and examinations under oath and prepares summary documents 
  • Prepares and conducts court appearances (matter management conferences, hearings, status conferences, etc.), including Federal Court
  • Conducts settlement/dispositive proceedings (e.g. mediations, arbitrations, etc.)
  • Conducts trials and/or available alternative dispute resolution options. Prepare motions in liminie and summary documents
  • Draft post-trial motions
  • Negotiates settlement and drafts related documents
  • Prepare for and participates in appeals
  • Provide legal opinions to claims clients
  • Investigate and pursue actions involving fraud against the company in No-Fault related matters
  • Review and determine strategy for legal issues sent to home office 
  • Participate in business process reviews with claims clients
     

Knowledge/Skills/Abilities/Experience

  • Core Competencies 
    • Intermediate skills/abilities/experiences in the following areas:  legal knowledge, business knowledge, issue management, analytical skills, influencing others, coaching and development, self development, and productivity
  • Other Requisites
    • Possesses a juris doctorate and a license to practice law in NY or MI Federal Court admission
    • 7+ years related experience typical.  SIU and/or Federal Court experience strongly preferred.  
    • Ability to manage complex litigation cases 
    • Computer skills, including MS Office suite, used in or related to the tasks performed 
    • Exercises discretion and maintains confidentiality of sensitive information
    • Demonstrates ethics and integrity
    • Has relevant experience within a reputable law firm or an in-house legal department for a mid- to large-sized organization
    • Insurance-industry experience preferred
    • Knowledge of legal holds and discovery processes
  • Management & Supervisory Skills
    • Budget management skills
    • Project management skills  
    • Able to interact with all levels of personnel and supervise/oversee the work of more junior resources
    • Utilizes subject matter expertise to coach and guide less experienced team members

***Location: This is a home work office location role within New York or Michigan, but must be able to travel to local courts for appearances 

Compensation offered for this role is $102,500.00-$175,000.00 per year and is based on experience and qualifications.
