Job Summary

NetApp U.S. Public Sector’s Legal Team is looking for an attorney to join our world class legal department and partner with our U.S. public sector sales organization. We are looking for a candidate who is agile, organized, motivated, and excited to work with sales teams and drive growth in NetApp’s U.S. public sector business.  You will bring experience in contracting with federal, state, and local government customers, including experience in structuring, drafting, and negotiating contracts and subcontracts; teaming agreements; reseller and other strategic go-to-market agreements; and purchase orders. You will also have experience advising sales teams on issues related to federal, state, and local government customers, such as cybersecurity, supply chain security, GSA and other GWAC compliance, and other laws and regulations applicable to the public sector industry.

Job Requirements

  • Review, negotiate, and draft a wide range of contracts and subcontracts with U.S. public sector customers and partners including teaming agreements, reseller agreements, direct agreements, non-disclosure agreements, certification and representations, purchase orders, and bid proposal responses.
  • Support compliance with U.S. government contracting laws, rules, and regulations in both the federal and state and local arenas. 
  • Contribute to establishment and support of compliance initiatives related to information security, cybersecurity, most favored nation requirements, and internal governance matters related to the U.S. public sector, including offering advice and training as needed.
  • Keep abreast of applicable laws, government regulations (including FAR/DFARS) and industry guidance that impact the hardware, software, services, and cloud businesses, and assist in the design and implementation of appropriate policies to ensure compliance.
  • Work directly with the business, providing day-to-day advice for public sector sales and other stakeholders on government contracting issues.

Skills and Abilities

  • Strong understanding of U.S. federal procurement laws, rules, and regulations for commercial products and services contracting, Federal Acquisition Regulation (FAR), and Defense Federal Acquisition Regulation Supplement (DFARS).
  • Working knowledge of state and local government contracting laws, rules, and regulations for commercial products and services contracting.
  • Ability to effectively synthesize, translate, and summarize complex topics into concise summaries for use by internal and external stakeholders.
  • Experience in commercial products and commercial services contracting with the federal government.
  • Excellent verbal and written communication, drafting, and negotiation skills.
  • Proficient in MS Word, Outlook, PowerPoint, Excel.
  • Exceptional attention to detail and proven ability to be self-directed.
  • Ability to take ownership and complete tasks timely; a self-starter.
  • Demonstrates initiative to simplify and improve work processes.
  • Solution-oriented:  You bring empathy and understanding to your conversations with customers, seeking to find a path forward that balances company risk and customer needs, and you think creatively beyond the legal terms to generate possible solutions and options for the business, while clearly articulating risk-based recommendations.
  • Ability to develop and maintain professional relationships and work well with senior-level and peer-level colleagues.
  • Team player with a good sense of humor and high level of integrity, responsibility and professionalism, and the ability to work in a dynamic, fast-paced, deadline-oriented environment.

  • Flexibility in working hours to accommodate clients throughout the continental United States.
  • Security clearance, or the ability to qualify for a security clearance. Must be a U.S. citizen.
  • You will be located in the Washington, DC metro area. Fully remote candidates may be considered on a case-by-case basis.

Education

  • Juris Doctor (JD) and membership in good standing of at least one state bar.
  • 4+ years of public sector focused legal experience, including demonstrated experience with federal and state and local government customers.
  • Previous work experience in a law firm, government, or as an in-house public sector attorney.
  • Experience with software, hardware, cloud, and related services preferred, but not required.

USA Residents Only:

The base salary hiring wage range for this position which the Company reasonably and in good faith expects to pay for the position in the specified geographic areas or locations,  is 180,000 – 240,000. Final compensation will be dependent on various factors relevant to the position and candidate such as geographical location, candidate qualifications, certifications, relevant job-related work experience, education,  skillset and other relevant business and organizational factors, consistent with applicable law.  In addition, the position may include some of the following comprehensive benefits such Medical, Dental, Vision, Life, 401(K), Paid Time off (PTO), sick time, leave of absence as per the FMLA and other relevant leave laws, Company bonus/commission, employee stock purchase plan, and/or restricted stocks (RSU’s).
