Summary: Under the supervision of the Associate General Counsel, the Senior Employment Counsel will (i) serve as a trusted strategic advisor and thought partner to Human Resources and global business stakeholders on all U.S. and worldwide employment-related legal matters; (ii) enhance existing employment practices and workplace policies, (iii) develop and deliver trainings on a variety of employment law topics; and (iv) manage outside counsel on employment litigation matters. The Employment Counsel will be based in our Carlsbad, CA office, with periodic travel to Acushnet’s headquarters in Fairhaven, MA and other worldwide locations.

Responsibilities:

  • Provide timely and strategic advice to Human Resources and global business stakeholders on all employment-related legal matters, including but not limited to, employee relations, wage and hour compliance, performance management, disciplinary actions, separations, organizational restructurings, internal investigations, accommodations, leaves of absence and worker’s compensation.
  • Supervise and manage outside counsel on (i) employment-related litigation matters, including litigation strategy, responses to administrative charges and communications with government agencies; (ii) immigration matters; and (iii) international employment matters.
  • Review, revise and implement employment handbooks, policies, procedures and practices to ensure compliance with applicable laws, regulations, legal standards and best practices.
  • Draft, review and negotiate employment-related documents including onboarding, separation, confidentiality, restrictive covenant and consulting agreements, to ensure compliance with applicable law.
  • Draft, review and negotiate employment-related vendor contracts including benefits, recruiting/staffing and HR technology contracts.
  • Develop and deliver proactive training to Human Resources and business leaders on a wide variety of employment law topics.
  • Monitor legislation, regulations, case law and government enforcement activities relating to relevant employment law areas, and provide proactive, strategic advice to relevant business partners.
  • Assist with a variety of employment-related legal issues pertaining to contracts, transactions, projects and initiatives as needed.

Requirements:

  • Strong academic credentials, including a Juris Doctorate degree from an ABA accredited law school.
  • Bar admission in at least one state required.
  • A minimum of seven years of employment law experience with a recognized law firm and/or in an in-house legal department, preferably in California.
  • Some domestic and/or international travel required.
  • Sitting for extended periods required.
  • Excellent knowledge of U.S. federal and state labor and employment laws and regulations (including, without limitation, ADA, ADEA, FMLA, FLSA, NLRA, etc.).
  • Expertise in California employment laws is preferred; however, the Employment Counsel will need to develop and maintain the necessary subject matter expertise to support locations in multiple U.S. states as well as internationally.
  • Practical business acumen, with the ability to balance legal risk with business impact, in order to drive pragmatic business-oriented solutions.
  • Accountable and pro-active self-starter.
  • Ability to work independently while contributing successfully to cross-functional teams.
  • Excellent interpersonal skills, with the ability to be a solutions-oriented and collaborative team player.
  • Excellent organizational skills, ability to prioritize and manage multiple projects and tasks simultaneously, while also managing critical deadlines.
  • Strong written and oral communication skills, including the ability to communicate effectively with internal and external partners.
  • Strong research, analytical and advisory skills, including the ability to review, evaluate and counsel internal clients on complex and routine employment law matters.
  • Sound legal and business judgment with the ability to identify and escalate issues when needed.
  • Positive, self-motivated individual with high level of enthusiasm and willingness to learn and incorporate coaching and instructions into daily tasks and assignments.
  • Enthusiasm for the sport of golf and the industry is a plus.
