Job Title : Compliance Officer, Banking as a Service (BaaS)

Summary

Overall responsibility for risk management and compliance in Banking as a Service division. Ensures that the operations of BaaS partners and providers comply with all federal and state banking laws and regulations related to regulatory compliance. Responsible for developing, implementing, and maintaining systems and processes to ensure ongoing compliance of all BaaS products.

  • Develop, manage, and support multiple risk and control programs for the business unit including defining the strategy, approach, processes, quality, tools and reporting that provide risk management consistency and excellence.
  • Supports the development, implementation, and administration of Bank policies, programs to establish controls, and compliance requirements to mitigate risk in BaaS operations.
  • Partners with other team members in onboarding activities, ongoing performance reviews and unwinding activities, as needed with BaaS partners. Monitor control assessment deliverables to ensure service level agreements stated within contracts are being met.
  • Provide compliance training to BaaS staff and partners to ensure that they understand their obligations under relevant regulations.
  • Develop and maintain compliance policies and procedures specific to BaaS operations. These policies should address the regulatory environment and be communicated to all relevant stakeholders.
  • Perform due diligence on BaaS partners to ensure they meet required compliance standards.
  • Conduct risk assessments to identify potential compliance risks and vulnerabilities in BaaS operations. This includes assessing risks related to data security, fraud, and other regulatory matters with partners and 3rd party providers.
  • Continuously monitor BaaS operations and BaaS partner activities and practices for compliance. Research and resolve any areas of concern. Recommend and lead solutions to address issue. Maintain comprehensive records of all compliance-related activities, reports, and policies.
  • Stay updated on all financial regulations applicable to operations, such as Anti-Money Laundering (AML), Know Your Customer (KYC), and data protection laws. Monitor the industry for changes in these regulations and ensure that the BaaS operations are compliant.
  • Prepare and submit regulatory reports and filings as required.
  • Develop and implement incident response plans to address and report any compliance breaches, data breaches, or other emergencies promptly.
  • Carry out responsibilities with professionalism, respect for others, in accordance with the organization's policies and applicable laws.

Organizational Structure

Reports to: Chief Compliance Officer or CEO

Supervises: Compliance Analyst(s)

Qualifications

Education

  • Bachelor's degree in Business, Finance, Law, or a related field.

Required Knowledge/Skills

  • 5 years experience as a compliance officer in BaaS operations
  • 3 years management experience (preferred)
  • Strong knowledge of regulatory compliance, risk management processes, and issue management
  • Deep knowledge of BaaS/ Sponsor Bank Partnership constructs
  • Extensive knowledge of financial institution policies and procedures
  • Extensive ability to read, analyze and interpret government regulations, trade journals and legal documents
  • Must be able to respond to common inquiries from regulatory agencies, courts, and outside consultants
  • Some periodic travel (approximately 25% travel)

Desired Knowledge/Skills

  • CRCM Certification
  • 7+ years in banking operations, compliance, and/or risk management.
