Position Summary

The Sr. Legal Counsel will provide strategic legal advice and counsel to internal business partners with respect to managed care contracting, provider arrangements, health care and pharmacy operations, and healthcare regulations and laws. The Sr. Counsel will also support the Specialty managed care team and the Coram infusion/pharmacy business unit to undertake and oversee the drafting, negotiation and implementation of specialty pharmacy standalone contracting, including managed care payor arrangements, and provide timely, practical and actionable legal guidance for all legal and regulatory matters related to and in support of the contracting function.  Additional activities include managing outside counsel and supporting internal stakeholders to protect company assets, mitigate risk, and optimize operational performance. The Sr. Counsel will also work collaboratively with CVS Health Legal, Finance, Compliance and Privacy to identify business and legal risks and provide solutions which balance legal issues and business objectives.

Required Qualifications

The Sr. Legal Counsel will have a strong work ethic, be a self-starter, and be able to be highly productive working with multiple cross functional teams in a dynamic, collaborative environment. This position offers broad exposure to many aspects of the company’s business, as well as significant interaction with legal and business leaders. The candidate will be expected to have the following key attributes:

  • Minimum of 8 years of experience as an attorney at law firm or in-house position in a role with working knowledge of healthcare laws and regulations, the False Claims Act, and the Federal Anti-Kickback Statute.
  • Excellent drafting and negotiation skills
  • Experience advising a health care research services organization.
  • Excellent interpersonal skills and an understanding of healthcare regulatory and contract law.
  • Strong verbal and written communication skills.
  • Ability to handle multiple priorities within deadlines without significant direct supervision.
  • Excellent analytical and problem-solving skills.
  • Sound professional judgment.
  • Responsive to requests and strong adherence to deadlines.

  • Licensed to practice law and current, active member in good standing of a state bar.

Preferred Qualifications

Knowledge of laws and regulations that impact the Specialty, Infusion/pharmacy business units, PBMs, including HIPAA, HHA licensing, Medicare, Medicaid (including Medicare/Medicaid billing and reimbursement issues), nurse licensing, patient safety and discharge regulations.

Ability To:

  • Identify business and legal risk while providing solutions to balance legal issues with business objectives.
  • Lead and influence others and while working collaboratively at all levels with internal and external parties.
  • Work in a in a fast-paced environment and successfully manage many projects – – whether large or small, complex or simple — simultaneously.

Education

Juris Doctor or equivalent.

Pay Range

The typical pay range for this role is:

$175,100.00 – $334,800.00

This pay range represents the base hourly rate or base annual full-time salary for all positions in the job grade within which this position falls.  The actual base salary offer will depend on a variety of factors including experience, education, geography and other relevant factors.  This position is eligible for a CVS Health bonus, commission or short-term incentive program in addition to the base pay range listed above.  This position also includes an award target in the company’s equity award program.
