Microchip Technology Incorporated (“Microchip”), is seeking an experienced IP litigation attorney for its Sr. Corporate Counsel – IP Litigation position, which supports all aspects of representing Microchip in patent lawsuits, patent assertions, and third-party discovery.  The successful candidate will be responsible for formulating and actively driving strategies for the resolution of litigation, with a focus on intellectual property litigation.  In this role, you will coordinate extensively with attorneys and paralegals within the Legal Department and with business and functional partners, technologists, and other executives within Microchip’s business units.

The Sr. Corporate Counsel – IP Litigation position reports to Microchip’s Director & Assistant General Counsel – IP & Litigation.  In this position, the successful candidate will:

  • Assist with representation of Microchip in global civil litigation matters with a focus on intellectual property litigation (patent, trademark, copyright and trade secret). 
  • Formulate case strategy; prepare objections and responses to discovery requests; implement electronic discovery collection, holds, and compliance; and review pleadings.  Develop infringement/non-infringement theories, invalidity theories, claim charts and IPR petitions.  Draft, review, and negotiate settlement agreements.
  • Review intellectual property claims and potential disputes, identifying Microchip’s best claims or defenses.  This includes searching for relevant prior art, drafting claim charts, preparing evidence of use, and drafting and/or reviewing IPR petitions.  Research and advise on liability and financial exposure related to disputes.
  • Provide guidance on accomplishing business objectives while managing the legal risk of disputes.
  • Manage outside counsel, coordinate litigation strategies, and provide regular updates for assigned matters.
  • Manage litigation expense budget for assigned matters.  Identify and use the most efficient and effective legal resources to complete the work in a timely and cost-effective manner.
  • Analyze patent portfolio, identify valuable patent assets, prepare evidence of use, and otherwise support patent monetization efforts.
  • Prepare responses and objections to third-party subpoenas.
  • Coordinate with in-house litigation paralegal on discovery tasks.
  • Assist in other substantive legal areas and work with other attorneys and staff as needed.
