Job Description

  • Position based in New York City
  • Act as litigation counsel for the Company with responsibility for the management of a wide range of product liability, class action, advertising, regulatory, commercial, insurance recovery, and other civil litigation matters.
  • Manage litigation and pre-litigation disputes; will be directly engaged in developing and driving litigation strategy and partnering with the business to identify potential litigation risks and solutions.
  • Provide counsel and guidance for the successful defense and resolution of lawsuits filed against the Company, while fully complying with applicable laws and regulations; provide informed cost benefit analysis when identifying risks; select and recommend alternative methods of dispute resolution, when appropriate.
  • Identify potential litigation or regulatory risk and counsel the business to minimize exposure.
  • Take a leading legal role in providing advice and counsel to internal clients relating to risk management, compliance, company policies and procedures, corporate governance, and operational issues.
  • Contribute to achieving both corporate and business unit strategic goals as a proactive member of the legal team and as a functional partner with other business and specialist counsel.
  • In partnership with the VP, Global Product Regulatory and Litigation, proactively set and execute legal strategies anticipating and addressing changes in laws, regulations and business environment to the advantage and benefit of the Company.
  • Serve as the primary advisor for legal hold issues, e-discovery, and subpoenas.
  • Develop and implement creative partnerships, approaches, and ideas regarding the management of the litigation budget.
  • Work with VP, Global Product Regulatory and Litigation and Legal Operations to select and retain competent, cost-effective outside counsel and experts. Develop strong working relationships with outside counsel, frame their performance goals, guide their work efforts and monitor their performance against budget.
  • Liaise with government regulatory bodies and administrative agencies on behalf of the company regarding product issues, inspections, and inquiries.
  • Partner with ELC business units in the development, implementation, and continued education of the company’s QA and Regulatory compliance policies and procedures.
  • Advise and consult with all levels of the organization including senior leadership to identify critical legal issues, assess potential legal options, and provide individuals and teams with an analysis and range of possible legal solutions

Qualifications
  • Must have Juris Doctor (JD) degree
  • Cosmetic and OTC industry experience
  • Licensed to practice law, NY preferred
  • 8-10 years of litigation experience at a law firm handling all stages of litigation combined with previous in-house experience preferred
  • Proven track record of successfully managing complex litigation; experience with talc litigation a plus
  • Experienced business lawyer with ability to form strong relationships with business leaders and serve as a counterpart to the QA and R&D teams
  • Ability to execute in a complex matrixed environment 
  • Highly motivated, efficient, and organized; able to juggle multiple projects at a time in a fast-paced environment, both collaborating as a team and working independently
  • Demonstrated ability to think strategically and creatively to solve complex legal challenges
  • Strong interpersonal skills, including the ability to communicate efficiently and to manage people effectively
  • Outstanding research, writing, analytical, and advocacy skills; must be able to read, interpret, present and explain legal defense strategies and documents to executives and staff
  • Able to lead projects and initiatives with little supervision or direction
  • Able to successfully collaborate with other legal and business colleagues in a complex, geographically dispersed organization
  • Excellent business judgment and communication skills

The anticipated base salary range for this position is $154,000 to $264,750. Exact salary depends on several factors such as experience, skills, education, and budget. Salary range may vary based on geographic location. In addition to base salary, this position is eligible for participation in a highly competitive bonus program with possibility for overachievement based on performance and company results as well as participation in the share incentive plan.
