The Assistant General Counsel - Compliance is a member of Littler’s Compliance Department. You will primarily work with other members of the Compliance team and other corporate teams including Tech Services, Talent, Finance, Marketing, Operations, and Knowledge Management. The Compliance Counsel will not represent Littler’s clients. Rather, you will act as counsel for Littler and help the Firm meet its Compliance goals. These goals include complying with applicable laws and regulations, helping our attorneys comply with their ethical obligations, meeting our client’s increasingly complex demands for protecting their information, and helping Littler distinguish itself from its competitors.

This is a hybrid position resident in Minneapolis, MN, Kansas City, MO, or New York, NY.

Pursuant to Minnesota regulation, the annual salary range for this position is $188,600 to $207,500 and includes eligibility for performance-based bonuses. Factors which may affect starting pay within this range may include geography/market, skills, education, experience and other qualifications of the successful candidate. Responsibilites

Legal Compliance

Identify applicable laws, regulations and frameworks relating to information security, privacy, retention, and disposition, applicable to Littler’s operations, as well as the exchange of information with those operations. Provide legal guidance on applying these requirements to the Compliance Program and other firm operations.

Support the Firm’s compliance efforts in accordance with applicable laws, regulations, ethics rules, and client requirements. Collaborate with other Compliance teams and Corporate departments to draft, implement, and enforce policies and procedures regarding Littler’s Compliance Program. Engage with outside counsel, as necessary, to support compliance initiatives.

Support the review and negotiation of client requirements related to privacy in client agreements. Advise on firm responses to client assessments, and participate in client audits, as needed to confirm compliance obligations. Collaborate with applicable Technology Services contacts to understand the firm’s capabilities.

Incident Management and Breach Response

Manage the Firm’s incident response process and any required security breach notifications, including documenting investigations and recommending changes to policies and processes to address root causes. Engage with outside incident response counsel and forensics consultants, as necessary to support incident and breach response activities. Collaborate with Compliance Operations and Tech Services Security Team to ensure policy and procedure changes are executed in a timely manner.

Policies Development and Annual Reviews

Responsible for drafting policies and procedures regarding Littler’s compliance programs and moving them through a review and approval process. In some areas, this may only require tracking final policies prepared and managed by other groups. Coordinate annual review of policies and procedures regarding Littler’s security programs. Collaborate with the Compliance Operations and Tech Services Security Team to ensure security is assessed as required by applicable laws or the firm’s policies, and as a part of the firm’s risk management processes.

Training and Awareness

Drive development of the content for the Firm’s information security awareness program for all Littler staff and contractors, including onboarding training, annual awareness training, regular awareness bulletins, quick reference guides and other materials appropriate for legal professionals.

Support Responsibilities

Ethics Compliance

Track developing requirements in ethics rules, opinions, and litigation (in the US and other countries where Littler does business) regarding an attorney’s obligations rearing the security and privacy of data relating to our representation of clients, including the obligation to protect client confidences and secrets and to remain competent in using technology.

Client Requirements

Assist in the review and tracking of client requirements related to information security, in client’s Engagement Agreements, Outside Counsel Guidelines, Business Associate Agreements, Requests for Proposal and other client agreements. Assist in the completion of client assessments and audits, as they relate to the Firm’s security obligations.

Governance, Risk & Compliance Tools

Coordinate with Compliance Operations to track all legal, regulatory and framework requirements related to security in the Firm’s Governance, Risk, and Compliance system.

Support Other Compliance Initiatives

Serve as additional legal counsel for all other Compliance team efforts.

Qualifications

  • Minimum 12 years of experience working with clients to manage information security, privacy, or information management programs or requirements.
  • Legal experience in the areas of compliance, privacy, security, and information retention and disposition.
  • Demonstrated ability to analyze large volumes of data, recognize trends, identify security and privacy risks, and help define policy, process, special projects, budgets, and programmatic changes to address these risks.
  • Demonstrated ability to drive issues to resolution and implement programs and policies by identifying obstacles and working with clients, practice teams, and corporate groups to develop solutions.
  • Demonstrated ability to manage multiple projects simultaneously, prioritize conflicting demands, and escalate issues, as necessary.
  • Demonstrated ability to work independently and remotely.
  • Ability to effectively negotiate privacy and security agreements with clients or customers.
  • Working knowledge of IT systems/technologies, policies and procedures used by large companies.
  • Excellent presentation and communication skills and the ability to communicate technical concepts to non-technical personnel, including Littler lawyers and clients, in a clear manner.
  • Excellent writing and drafting skills.
  • Strong organizational and communication skills.
  • Experience with project management disciplines and the ability to effectively manage projects to successful completion.
  • Familiarity with applicable Compliance and security frameworks, including ISO 27001/2, NIST Cybersecurity Framework and associated NIST guidelines, HiTrust framework, SSAE18 Trust Service Principles, etc.
  • Experience with and working knowledge of applicable information security, privacy, and information management laws and regulations, including state privacy, security, and breach notification laws; HIPAA/HITECH; EU Data Privacy Directive, GDPR, CCPA, Mexico Data Protection laws, PIPEDA, etc.

Education & Certifications

Required: Juris Doctor, Bar Admission

Preferred: Privacy or security certifications, including CISSP, CIPM, CISM, CIPP/E, CIPP/US, etc.
