This Associate General Counsel role at OptumInsight is primarily responsible for providing business legal advice to the OptumInsight subrogation business team. This role will have a high level of interaction with the subrogation business team, external customers, and strategic partners to provide timely updates and counsel on various legal and regulatory issues. Additionally, this role may involve substantial interaction with regulators, opposing counsel and courts on issues relating to subrogation matters.

Primary Responsibilities:

  • Support the OptumInsight, Inc. subrogation business by providing legal, risk management, and case resolution advice to business leadership, operational managers, and case negotiators
  • Serve as an initial point of legal contact for privacy, contracting, and compliance issues for the subrogation business
  • Negotiate high dollar, complex or sensitive reimbursement cases
  • Coordinate and manage affirmative reimbursement litigation on behalf of fully insured, ASO, Medicaid and Medicare Advantage plans in state and federal courts
  • Respond to regulatory requests, investigations and examinations involving the subrogation business
  • Collaborate with colleagues across the UnitedHealth Group legal departments

Required Qualifications:

  • Undergraduate degree
  • Juris Doctorate degree and license to practice in any U.S. jurisdiction
  • 5+ years of litigation experience, including preferably some trial work, prosecuting or defending personal injury matters
  • Ability to evaluate and determine appropriate legal courses of action to meet business needs
  • Full COVID-19 vaccination is an essential job function of this role. Candidates located in states that mandate COVID-19 booster doses must also comply with those state requirements. UnitedHealth Group will adhere to all federal, state and local regulations as well as all client requirements and will obtain necessary proof of vaccination, and boosters when applicable, prior to employment to ensure compliance. Preferred Qualifcations:

  • Experience prosecuting or defending subrogation or payer reimbursement matters 
  • Experience responding to department of insurance complaints and regulatory inquiries
  • Substantial settlement negotiation experience
  • An understanding of the healthcare industry including coverage, benefits, claims payment and payor issues
  • An understanding of relevant laws including ERISA, the Medicare Secondary Payer Act, FEHBA, HIPAA, and Medicaid and various state laws as they apply to health care subrogation and reimbursement
  • Excellent writing and oral communication skills
  • Ability to work independently to support a fast paced and high-volume payment integrity business
  • Ability to work independently with a high degree of personal initiative to understand complex legal and corporate issues
  • Solid verbal and written communication skills, as well as excellent presentation skills
  • Ability to build and maintain rapport with superiors, peers, subordinates, internal company contacts and external stakeholders
  • The ability to operate in a highly matrixed and complex legal and business environment

Colorado, Connecticut or Nevada Residents Only: The salary range for Colorado residents is $113,500 to $218,100. The salary range for Connecticut / Nevada residents is $113,500 to $218,100. Pay is based on several factors including but not limited to education, work experience, certifications, etc. In addition to your salary, UnitedHealth Group offers benefits such as, a comprehensive benefits package, incentive and recognition programs, equity stock purchase and 401k contribution (all benefits are subject to eligibility requirements).
