The Optum Associate General Counsel-Privacy works closely with the Chief Privacy Officer and the Optum Privacy Office to support the Optum Rx privacy program, with focus on the HIPAA Privacy and Security Rules. This role will also serve as a subject matter expert for state privacy laws, ensuring their implementation and compliance. As a key member of the Optum Privacy team, this position provides overall privacy counsel and oversight for Optum Rx with respect to all regulatory and compliance-related privacy activities. This includes privacy counsel to diverse teams, including business legal, marketing, information security, human capital, and product teams.    

The position can be in the office, depending on your location, or you’ll enjoy the flexibility to telecommute* as you take on some interesting challenges.

Primary Responsibilities:

  • Maintain current knowledge of privacy laws, including state and federal healthcare and privacy laws
  • Develop, manage and implement a privacy program for specific business requirements (for example, Notice of Privacy Practices, authorizations, mobile devices, individual rights, and online privacy policies)
  • Conduct annual privacy risk assessments and implement an annual plan to address key risks identified
  • Conduct privacy product assessments, including Privacy by Design, and provide related counsel
  • Draft, manage, and negotiate Business Associate Agreements (BAAs) and other privacy and related legal documents
  • Oversee remediation and corrective action plans resulting from audits, investigations, privacy reviews, and self-identified issues
  • Lead privileged privacy incident investigations
  • Facilitate delivery and where necessary development of a privacy training and awareness program
  • Oversee and review development of operational privacy policies and procedures as needed and draft policies, checklists, and other guidance for our businesses 
  • Deliver privacy reports to business and Optum privacy leadership on a regular basis
  • Collaborate with Optum Compliance to support new entity due diligence and integration
  • Partner with Information Security for company-wide technology and security solutions implicating privacy

Required Qualifications:

  • Juris Doctorate from an ABA accredited law school with excellent academic credentials; admission to practice in good standing as a member of a jurisdiction 
  • Knowledge of privacy laws, with an emphasis on HIPAA and healthcare privacy knowledge

Preferred Qualifications:

  • Privacy certification a plus, such as CIPP-US, CHPC or other healthcare industry related credential
  • 4+ or more years of experience providing complex legal counsel to clients (preferably in the area of privacy and security)
  • 4+ years of progressive experience in at least one of the following categories-legal, compliance, regulatory, investigation or privacy (healthcare and privacy focus preferred)
  • Experience with Business Associate Agreements
  • Knowledge of state consumer privacy laws, such as the CCPA, CPRA, BIPA, CPA, VCDPA, CPDPA, and UCPA 
  • Knowledge of state sensitive health information laws, such as those addressing genetic information, mental health, substance use, reproductive health, HIV/AIDS, and minors’ health information
  • Familiarity with data security standards and frameworks (NIST, FISMA, HIPAA, etc.)
  • Interest in privacy as a career and continued privacy professional development 
  • Interest in the governance and oversight of data from a privacy perspective, particularly for innovative use cases 
  • Collaborating: Strong Team player with excellent collaboration and people skills
  • Communicating Effectively: Exceptional written, verbal, and presentation communication skills
  • Critical thinking: Superior analytical, organizational, and problem-solving skill 
  • Excellent interpersonal skills and the ability to work with highly matrixed functional areas, business segments, and external companies
  • Ability to think strategically and to translate directives into tactical initiatives
  • Ability to focus on the customer, client, and patient, and demonstrated responsiveness
  • Ability to implement and operationalize privacy regulatory requirements
  • Ability to assess complex problems and provide the appropriate compliance and privacy solutions

Colorado, Connecticut or Nevada Residents Only: The salary range for Colorado residents is $113,500 to $218,100. The salary range for Connecticut / Nevada residents is $113,500 to $218,100. Pay is based on several factors including but not limited to education, work experience, certifications, etc. In addition to your salary, UnitedHealth Group offers benefits such as, a comprehensive benefits package, incentive and recognition programs, equity stock purchase and 401k contribution (all benefits are subject to eligibility requirements).
