About the Role
The Privacy Counsel will be a key member of the Hinge Health legal team, focused on privacy issues. You will be the in-house expert on privacy and provide timely review and guidance for new products and features in digital and in-person MSK care from early stages of development through launch and for our consumer messaging and marketing programs, materials and tactics.
 
You will be expected to stay up-to-date on relevant laws and regulations in the data privacy space, and lead, architect and drive forward privacy compliance plans and programs. You will have the opportunity to pitch in on other matters as needed as part of a fast-moving, lean, efficient legal organization.

WHAT YOU’LL ACCOMPLISH

  • Act as a key internal lead and subject matter expert on all matters relating to privacy law, including providing practical, timely, strategic, and high-quality legal advice on data privacy and security matters.
  • Actively monitor, brief, and advise on privacy laws and new legislative and regulatory developments, including taking lead on developing and updating policies and procedures and developing and updating internal workplans to comply with upcoming data privacy regulations. Collaborate with Information Security team and Compliance team to mitigate data privacy and security risks.
  • Lead on reviewing products and product features to ensure compliance with data protection laws.
  • Lead in reviewing marketing initiatives to ensure compliance with data protection laws.
  • Lead on reviewing, drafting, and negotiating of privacy and data security terms in contracts with clients, business partners and vendors, including Data Sharing Agreements and Business Associate Agreements.

WHAT WE'RE LOOKING FOR

  • You are an attorney with a JD, admission to a state bar, at least [7] years of relevant experience in-house in healthcare or at a law firm focused on healthcare data privacy matters.
  • You have a comprehensive understanding of and experience with providing advice on data privacy and related statutes, regulations and guidance is required, particularly HIPAA as well as CCPA, CPRA, and state data privacy laws. Experience with TCPA and/or GDPR, PIPEDA and other international privacy structures] is a plus.
  • You have experience providing advice on digital health products, service designs, and marketing initiatives , from a data privacy perspective.
  • You have experience driving compliance work plans and projects forward, including rolling up your sleeves to get things done when needed, and experience leading and taking ownership over privacy compliance programs, including working cross-functionally to get stakeholder buy-in and drive projects forward.
  • You have experience clearly communicating, triaging and summarizing compliance requirements across different regulatory frameworks, including working with cross-functional teams to understand requirements.
  • You have experience drafting and negotiating Data Sharing Agreements and Business Associate Agreements and advising on contractual terms related to privacy and security.
  • You are comfortable working in a fast-paced and high-growth environment in a rapidly changing and sometimes ambiguous compliance environment, triaging compliance needs and handling tasks and answering questions that are unfamiliar to you. 
  • You have a strong willingness to take on and drive projects from start to finish.

The range of base salary for the position is between $152,000 - $276,000, plus equity, and benefits.  Please note that the base salary range is a guideline, and individual total compensation will vary based on factors such as qualifications, skill level, competencies and work location.
