What to Expect

The Corporate Counsel, US Immigration will be a critical individual contributor to Tesla’s global immigration team in the talent mobility organization. This position will be responsible for building strong relationships and partnering with cross-functional partners including recruiting and HR to execute immigration sponsorship assessments in-house prior to engagement of outside counsel. The role directly advises the business and employee customers with respect to employment-based immigration matters including non-immigrant visas (NIV) and permanent residency applications (IV). The role will be responsible to lead high volume business critical projects and programs and provide indirect oversight and leadership to the immigration specialist support team. This position will be located at Gigafactory Texas, located in Austin, Texas. 

What You’ll Do
  • Assess feasibility of new hire immigration sponsorship and advise recruiting partners on critical steps, potential issues, and timelines to start for new hires and internal employee transfers.
  • Partner with recruiting technology, applications engineering and support teams on continuous improvement efforts to our home-grown ATS software.
  • Provide legal advice and strategic direction through email, virtual calls, and face to face meetings to Tesla employees, managers, HR and other stakeholders regarding immigration cases.
  • Counsel internal stakeholders regarding the full range of issues that may arise during immigration sponsorship.
  • Provide indirect oversight to Immigration Specialists’ case management of NIV and IV cases that are handled by outside counsel.
  • Run reports and contribute to the monitoring and maintenance of employees’ immigration statuses, including monitoring expiration dates, filing dates, etc.
  • Provide creative and business-focused problem-solving, balancing any potential legal risk and business impact.
What You’ll Bring
  • Advanced knowledge of employment-immigration law, including experience with 4+ years in a high-volume setting.
  • Direct experience with E-3, F-1 (CPT/OPT/STEM), H-1B, J-1, L-1, O-1, and TN nonimmigrant visas.
  • Direct experience with PERM, EB-1/2/3 I-140, consular process and adjustment of status.
  • Law degree with a strong academic background.
  • Bar license in any U.S. jurisdiction.
  • Strong legal writing and drafting skills.
  • Accuracy and attention to detail.
  • Proven ability to supervise/mentor paralegal staff and foster their continual growth.
  • Experienced professional with an energetic disposition, great relationship skills, team player, self-starter, independent thinker, with the ability to anticipate and solve for big picture programmatic issues.
  • Ability to multi-task and contribute in a cross-functional environment.
  • Must have solid knowledge of Microsoft Word, Outlook, Excel and PowerPoint, as well as Immigration database software.
  • Experience with global immigration practice a plus.
