You can exercise sound strategic, legal, and business judgment in challenging situations. You can voice any concerns and make others understand your opinion.

What You'll Do:

The Business Affairs Director is charged with being a partner in the creative process from pre-production to post. As such, you will look at the following:

PRE-PRODUCTION

Risk / Legal Assessment:

  • Red flag creative prior to external counsel legal review
  • Send boards and/or script to insurance and talent payment companies to assess legal risk - required as needed, multiple phone calls with production

General:

  • Advise on client production guidelines and client MSA
  • Ballpark costs with Producer to gauge client feasibility
  • Discuss and verify all usage terms for talent and/or music (i.e. Term, Territory, Media, Cost, Deliverables)
  • Partner with Producer on creating bid specs
  • Review and negotiate all vendor bids with Producer and partner with Cost Consultant for feedback and approval. Multiple rounds of review. Triple bid Policy in effect.
  • If 3rd party rights are applicable, advise team on best practice

Talent:

  • Advise on SAG guidelines per project specs
  • Talent estimation for shoot and securing cost consultant approval, if required
  • Negotiate original spot & edits with talent agents
  • Facilitate talent background check with Agency legal when applicable.
  • Manage talent procurement process with external partners for all celebrity talent contracts, act as agency liaison between vendor, account and client. Confirm all business terms.

PRODUCTION

Contractual:

  • Draft and execute production contracts, live action, vfx, animation, etc.
  • Draft and execute all production release forms needed. I.e. IPR, props, location, branding, etc.
  • Secure all required insurances through insurance company including special insurance, general liability insurance, aircraft, drone, etc.
  • Manage project with Omnicom Risk to secure all required special insurances when applicable such as a live event etc.
  • Music Licensing - negotiate terms with all rights owners. Complex negotiation that may include several parties for the individual master, publisher and artist. If applicable, work with music procurement company. Contact AFM for estimates of costs associated with using tracks.
  • Partner with Producer to secure all stock footage and image rights.
  • Manage vendor negotiations and disputes of legal documents (contracts, NDA, PO terms, licenses).

Finance:

  • Issue and manage all vendor PO's and invoices.
  • Follow up with account on client estimate approval to ensure vendor payment.

Talent:

  • Manage celebrity talent and influencer agreements.
  • Secure waivers for all stunt performers and liaising with Clients & Agency legal to approve language, when applicable.
  • Secure talent releases for Union and Buyout
  • Advise on ongoing talent inquiries.
  • Work with SAG to secure waivers, i.e. Live event, Testimonial, Low Budget Digital.
  • Process all Talent session reports, contracts and invoices.
  • Partner with Talent Manager to ensure residuals are accounted for.

POST PRODUCTION

Talent:

  • Manage multiple talent requests to confirm existing usage, new estimate requests for potential usage with Talent Manager.
  • Review final spot with Producer and Talent Manager. Provide input on completion reports to ensure usage is captured accurately for all deliverables.

Finance:

  • Manage vendor follow-up on payment
  • Maintain job status reports to ensure costs incurred are accurate. Request job transfers as needed.
  • Input client specific budget details in tracking docs
  • Reconcile job which includes working with Finance on job closings, reviewing expenses and ensuring all costs have hit.
  • Maintain accurate timesheets that are completed by required deadlines

Location:

_Given the nature of our Business Affairs team and the client assigned to this role, we are only considering candidates that currently live in or wish to relocate to New York City, in the near future (first 60 days of employment).

_ _The annual salary range for this role is $170,000 – 200,000 and may vary depending on the candidate's geographic location and experience. Other compensation includes relocation costs, if applicable.
