POSITION SUMMARY/OBJECTIVE Responsible for coordinating all legal activities of the collections, loan servicing, and lending departments. Organize, plan, and manage all activities associated with member accounts, including Visa credit and debit cards, lines of credit, secured loans, real estate loans, shares and home equity lines of credit involved in bankruptcy or legal proceedings. Reviews accounts, determines Credit Union position and, as circumstances dictate, directs and assists internal/external legal counsel in proceedings. Performs periodic evaluation of bankruptcy procedures and modifies as needed. Ensures that established policies, procedures, and legal requirements are followed. ESSENTIAL FUNCTIONS • Coordinates attorney partners, lawsuits, and legal matters for the credit union. Appears in court for any legal matters. • Partners with management to update workflows. Conducts periodic review of existing procedures to ensure maximum efficiency. • Directs and schedules workflow on all legal matters. • Utilizes effective human relations skills to present a positive Credit Union image. Calms irate members and answers member questions and complaints relevant to bankruptcy and litigation matters. • Determines Credit Union position in bankruptcy proceedings and works to minimize losses. • Handles and coordinates legal matters on behalf of loan servicing and at the request of the leadership team. • Works toward prompt recovery of collateral through negotiations with bankruptcy attorney and/or court. • Monitors loans to ensure bankrupt members have adequate insurance coverage to protect collateral and the Credit Union's interests. • Directs legal counsel in all court complaints and post judgment actions • Monitors all attorney and bankruptcy accounts to ensure documents and legal proceedings are filed and followed up by legal counsel in a timely manner. • Keeps up-line informed of area operations and of any significant problems. • Stays informed of changes in collection policies, procedures, and related legal requirements. • Documentation preparation, filing and service of legal documents. • Responsible for drafting legal documents under the direction of the Staff Attorney. • Processes trustee payments. Codes accounts appropriately. • Reviews member accounts via multiple software platforms and communications with Collections and Risk Management staff. • Ensures assets and monies recovered through legal process are applied to the appropriate account(s) in order of priority. QUALIFICATIONS • High school diploma or equivalent. • 3+ years of similar or related experience in a law firm or full-service financial institution. • Thorough knowledge of collection procedures and related laws and regulations. • Extensive knowledge of bankruptcy and legal matters. • Knowledge of loan contract terms, contracts, and agreements including membership agreement. • Computer proficiency with MS Office, including Word, Excel and PowerPoint, Internet, and Email.
