General Summary

The Privacy and Marketing Counsel will provide legal support on a broad spectrum of privacy issues concerning Campbell’s businesses, as well as marketing, advertising and policy issues.  

This lawyer will advise the Company on compliance with applicable federal, state and international data protection and privacy laws and regulations, as well as the development, implementation and maintenance of robust privacy policies and practices. In the marketing space, this lawyer may advise teams on product claims and substantiation as well as the regulatory compliance of the portfolio of Campbell’s iconic brands.  The ideal candidate will be a commercially-minded, pragmatic business lawyer with significant experience with privacy regulatory frameworks and cybersecurity obligations. 

The Privacy and Marketing Counsel position is based in Campbell’s World Headquarters in Camden, New Jersey, and this individual will be a member of the Campbell Legal Department. The privacy counsel will report to Campbell’s Senior Vice President and Associate General Counsel – Intellectual Property, Marketing, Privacy and Food Law. The successful candidate must be able to work effectively with numerous clients in a cross-functional, team-oriented environment.

Primary Responsibilities

  • Maintain subject matter expertise in areas of privacy and data protection laws – federal, state and as applicable, international – and advise on compliance and on the impact to the Company; 
  • Development, implementation and maintenance of all of Campbell’s privacy policies, procedures and practices to ensure compliance with all applicable laws and benchmarking to best practices, including monitoring effectiveness
  • Review agreements and counsel on privacy, data protection and cybersecurity provisions, as well as issues implicated by relationships with vendors and other third parties; develop and maintain templates for frequently used agreements and provisions;
  • Advise the Information Security team; provide guidance on protocols and procedures for handling incidents including, but not limited to, data breaches, privacy incidents, and cybersecurity events; 
  • Counsel cross-functional crisis management team on internal and external stakeholder engagement; manage investigations into suspected events; develop policies and processes and provide guidance on notification obligations, including notifications to authorities, consumers, employees and third parties 
  • Provide ongoing education and conduct regular compliance training related to privacy and data protection issues, relevant Campbell policies and practices, and relevant role/function specific concerns;
  • Advise and counsel business teams on how to incorporate privacy considerations into project development processes
  • Collaborate with internal legal, IT, security, HR, communications and compliance teams to align efforts and ensure a holistic approach to privacy;
  • Development and maintenance of strategies for monitoring and addressing emerging legal and policy developments;
  • Advise on privacy law and related issues and conduct due diligence in connection with acquisitions, divestitures, and other transactional matters;
  • Work closely with the in-house litigation team to defend privacy and data protection litigation matters, including matters arising from any privacy, data protection or cybersecurity events;
  • Effectively manage outside counsel relationships and related budgeting matters;
  • Support organization-wide legal projects and initiatives, as necessary;
  • Provide counsel on additional matters as needed and directed by management. 

Marketing Law Responsibilities could include the following:

  • Advise and counsel the Marketing teams on issues relating to the marketing and advertising of new and existing products; including traditional and digital marketing as well as social media executions;
  • Advise on privacy and related laws that commonly impact marketing and advertising, including but not limited to COPPA and CAN-SPAM
  • Advise of statutory and regulatory requirements and strategic intervention in the regulatory agendas of the FTC, FDA and USDA;
  • Advise and counsel on claims substantiation;
  • Support of relationships with outside vendors such as advertising and media agencies; and third parties such as brand and product spokespersons, influencers and marketing partners, including advising on marketing-related agreements, 
  • Development of corporate policies and participation in the management of public policy issues relating to the marketing and advertising of our products;
  • Conduct regular compliance training related to marketing law, legal risks and relevant Campbell policies and practices;
  • Work closely with the in-house litigation team to defend labeling and marketing-related class action litigation matters

Minimum Requirements

  • Juris Doctorate from an ABA accredited law school.
  • A member in good standing of any state bar (if not already admitted in New Jersey, the successful candidate will need to obtain the relevant in-house bar admission).
  • At least five years of law firm and/or in-house experience.  Privacy law experience is required; Certified Information Privacy Professional (CIPP) or other relevant certifications are ideal but not required; marketing law experience preferred but not required. 
  • Excellent analytical and communication skills, both oral and written.
  • Demonstrated team player with strong interpersonal and organizational skills.
  • Ability to handle and prioritize multiple projects simultaneously.
  • Ability to interact effectively and efficiently with business partners daily and operate with limited supervision. 

Compensation and Benefits:

The target base salary range for this full-time, salaried position is between 

$125,500-$209,300

Individual base pay depends on work location and additional factors such as experience, job-related skills, and relevant education or training. Total pay may include other forms of compensation. In addition, we offer competitive health, dental, 401k and wellness benefits beginning on the first day of employment.
