Position Overview

Exact Sciences seeks a motivated, nimble, collaborative, and experienced attorney to join our Global Privacy Office as a Privacy Counsel focused on research and international market support. We're seeking an attorney with expertise in global privacy and data protection laws to help solve challenging privacy issues impacting Exact's global business. Responsibilities include contract review and business guidance supporting data protection matters for research, international legal, medical affairs, marketing, and commercial teams. This role reports to the Chief Privacy Officer.

This position will be in Madison, WI, Zug, Switzerland, or remote (US).

Essential Duties

Include but are not limited to the following:

  • Serve as a subject matter expert in areas of data use and protection laws (including U.S. state and federal consumer protection and privacy laws, GDPR, UK GDPR, and other global privacy laws) and provide practical advice that achieves business objectives.
  • Demonstrate subject matter expertise by providing guidance using relevant data protection laws and regulations to support enterprise research in the U.S. and International markets.
  • Supports colleagues across the legal department in structuring, drafting, and negotiating transactional documents to respond to and support enterprise objectives.
  • Provide legal advice to the Global Privacy Office to streamline global privacy operations.
  • Work closely with product counsel and product teams to guide privacy-forward product development and evaluate the impact of privacy laws, regulatory guidance, and enforcement actions.
  • Drive high-profile and high-impact projects involving privacy analysis and compliance with cross-functional stakeholders across the business.
  • Support members of the legal and business teams on privacy legal matters, including areas related to partnerships, acquisitions, integrations, and other business development opportunities.
  • Help to develop and conduct general and role-specific privacy training across Exact Sciences.
  • Willing and eager to take on new areas of law and function independently in a demanding, fast-paced environment.
  • Ability to think quickly on your feet, convey grace under pressure, simultaneously manage workloads for multiple client demands, and shifting priorities.

  • Ability to work on a mobile device, tablet, or in front of a computer screen and/or perform typing for approximately 90% of a typical working day.
  • Ability to travel 10% of the working time away from the work location, which may include overnight/weekend and international travel.

Minimum Qualifications

  • J.D. degree (or foreign equivalent) and membership in at least one US state bar.
  • 7+ years of legal experience, including at a law firm and/or in-house experience.
  • 5+ years working on Privacy matters.
  • 3+ years experience providing guidance on Research under the Common Rule and GDPR.
  • Strong knowledge of GDPR, UK GDPR, HIPAA, and US State Privacy Laws.
  • Strong C1 or better English proficiency in written, spoken, and reading.
  • Experience advising on healthcare privacy legal (federal and state) risks and mitigations.
  • Proficiency with MS Word, Excel, and PowerPoint.
  • Demonstrated ability to perform the Essential Duties of the position with or without accommodation.

Preferred Qualifications

  • Experience with additional global privacy laws, regulations, and industry guidelines beyond those listed in minimum qualifications, especially including those relevant to research and International laws.
  • In-house experience with applicable product counseling, compliance, litigation, or regulatory teams.
  • Experience prioritizing work and providing advice under deadlines.
  • Business judgment and client counseling experience.
  • Experience working cross-functionally to advance projects in a multi-stakeholder environment.
  • Experience in medical technology, biotech, healthcare, or related field.

Salary Range:

$152,000 - $242,000

The annual base salary shown reflects the combined salary range for both titles. Placement within the annual base pay range will vary depending on experience and location. In addition, this position is bonus eligible, and is eligible to receive company stock upon hire as well as annually.
