Job Summary

A Counsel – Litigation serves as a member of Flagstar Bank's Legal Department and is responsible for providing primary E-Discovery legal support, litigation management, and providing legal advice and support to Flagstar Bank's various lines of business under the supervision of managing attorneys.

Job Responsibilities

• Primary responsibilities will require this attorney to be an eDiscovery specialist, work with the bank's document review team to identify, review and produce responsive documents requested via civil, third-party and agency subpoenas as well as in-house litigation matters
• Ensures accurate and thorough reviews are conducted in an efficient and cost-effective manner. Construct search terms for targeted technical searches using internal software.
• Reviews legal pleadings related to requests for documents for legal compliance and responds appropriately including filing appropriate objections; engages outside counsel as necessary; Accountable for the completion of assigned deliverables, processes, and programs. Ability to act autonomously on most non-complex issues/decisions.
• Manages new and threatened litigation against the bank. Provide timely review, analysis, legal advice and recommendations to the impacted business areas, developing litigation strategies, selecting and managing outside counsel engaged to represent Flagstar in these matters and reviewing and approving all necessary pleadings.
• Responds to legal inquiries from internal colleagues in other departments/disciplines, related to banking, lending, and general corporate matters.
• Individual contributor that supports senior lawyers in the department on transactions and assignments.
• Works under supervision of senior lawyers in legal department to provide legal advice and counsel on a variety of matters relevant to the business of a commercial bank and broker-dealer. Provides interpretation of various federal and state regulations applicable to Flagstar Bank. Performs legal research as needed.
• Has direct experience working for a practice group at a large bank and/or mid to large law firm providing litigation support to financial institutions, and be familiar with current market practice, litigation trends, applicable state and federal banking and mortgage-related regulations and guidance issued by relevant financial services, banking and mortgage trade associations.
• Stays current on all relevant caselaw, state and federal regulations, and any changes that may affecting/impact the various businesses and company

Additional Accountabilities

• Performs special projects, and additional duties and responsibilities as required.
• Consistently adheres to regulatory and compliance policies and standards linked to the job as listed and complete required compliance trainings. Accountable to maintain compliance with applicable federal, state and local laws and regulations.

Job Requirements

Required Qualifications:

• Juris Doctorate from an accredited law school
• 5+ years of relevant legal experience practicing at a law firm and/or in-house legal department at a commercial bank or other equivalent financial services company.
• Documentation experience should include experience with eDiscovery, litigation management, including motion and trial practice.
• Member in good standing of bar of state in United States, with ability to become a member of the State Bar of Michigan through corporate affiliation or reciprocity.
