Job Description

The Senior Counsel, Legal Compliance position is responsible for developing legal strategy and direct support of cross-brand, brand-agnostic, and enterprise-wide groups and functions. This position will provide counsel concerning a broad range of legal, regulatory and compliance issues, with a primary focus on fraud & abuse statutes and regulations including the Anti-Kickback Statute, the False Claims Act, FDA promotional regulations, state compliance laws and regulations, and DOJ and HHS-OIG guidance.

This position reports to the Senior Associate General Counsel, Legal Compliance.

Responsibilities

 

  • Serving as counsel for a diverse set of clients across the company and frequently interacting with and providing substantive advice to Commercial, Marketing, Regulatory Affairs, the Office of Ethics and Compliance, and other departments concerning a broad range of legal, regulatory and compliance issues, including FDA regulations, False Claims Act, Anti-Kickback Statute, OIG guidance, relevant industry codes, the Sunshine Act, and the Prescription Drug Marketing Act, among others.
  • Providing legal advice on relevant policies, procedures and trainings, in consultation with the Office of Ethics and Compliance and other departments.
  • Resolving routine legal matters in practice area with direct supervision as needed from more experienced attorneys. Assisting more experienced attorneys in resolving complex legal issues on cross-functional projects.
  • Developing knowledge of AbbVie’s business and supported client areas. Keep abreast of changes in laws that affect client areas.
  • Where necessary, reviewing and negotiating agreements (including consulting agreements and other corporate agreements) that may impact healthcare compliance.
  • Working cross functionally with other Legal groups, Regulatory Affairs, the Office of Ethics and Compliance, Marketing, and other departments to find solutions to meet business objectives consistent with the law, applicable policies/procedures, and AbbVie’s Code of Conduct.
  • Helping select and direct the work of outside counsel, define project objectives and manage projects.
  • No direct department budget responsibility must however operate within budget. Where necessary, develop budgets for assigned legal matter(s) with supervision from more experienced attorneys.
  • Staying up-to-date on developments in healthcare laws and guidelines, identifying unmet needs and future legal issues, and proactively proposing strategies to optimize outcomes and results for patients, providers, and the company, while managing risk.
  • Being committed to meeting patient unmet needs across AbbVie’s therapeutic areas and energized to rise to new challenges and envision creative solutions.
  • Serving as recognized source, for the business as well as other attorneys, regarding innovative ideas in complex areas of law, business, or technology, particularly those impacting the enterprise-wide clients that Legal Compliance serves.

Qualifications

 

  • Law degree from an ABA accredited law school and in good standing with the state bar of the jurisdiction in which your office will be located (or ability to gain licensure in the state in which your office will be located)
  • Minimum 7 years of relevant experience.
  • Experience with pharmaceutical/medical device/biotech companies required, and educational background in applicable scientific field is a plus.
  • Excellent written and verbal communication skills, including the ability to communicate complex legal issues in a simple, understandable manner with colleagues across the company.
  • Strong collaborative skills, able to build partnerships internally and with external partners at all levels of the organization.
  • Strong organization and time management skills with flexibility, creativity, resourcefulness to successfully prioritize and manage multiple, competing priorities simultaneously.

  • The compensation range described below is the range of possible base pay compensation that the Company believes in good faith it will pay for this role at the time of this posting based on the job grade for this position. Individual compensation paid within this range will depend on many factors including geographic location, and we may ultimately pay more or less than the posted range. This range may be modified in the future.
