Job Summary and Qualifications
As Sr. Litigation Counsel at HCA will actively manage civil litigation and arbitration proceedings as well as civil and criminal government investigations on behalf of HCA Healthcare and its affiliates. Conduct internal investigations in conjunction with outside counsel and/or internal business colleagues. You will analyze and advise clients on potential civil litigation and arbitration claims and disputes. Analyze and advise clients on various areas of substantive healthcare law, including the False Claims Act, the Anti-Kickback Statute, the Stark Law and the Controlled Substances Act. Supervise assigned staff, including contract attorneys, paralegals, legal assistants and legal secretaries.
General Responsibilities
Actively Manage Civil Litigation and Arbitration Proceedings
· Analyze and advise clients on all aspects of claims and defenses at issue in civil litigation and arbitration proceedings, including the potential resolution of such proceedings;
· Select and manage outside counsel and other litigation and arbitration experts;
· Analyze and approve litigation and arbitration strategy of outside counsel, including the review and approval of significant correspondence, court filings and discovery responses, to ensure consistency with business objectives and interests;
· Assist outside counsel with all phases of fact and expert discovery, including e-discovery and depositions
· Advise and update Vice President-Litigation on pending and potential civil litigation and arbitration proceedings.
Actively Manage Civil and Criminal Investigations
· Analyze and advise clients on all aspects of civil and criminal investigations, including the potential resolution of such proceedings;
· Select and manage outside counsel and other investigation experts;
· Analyze and approve strategy of outside counsel, including the review and approval of significant correspondence and presentations, to ensure consistency with business objectives and interests;
· Assist outside counsel with all phases of investigations, including witness interviews and responses to information or testimony requests;
· Advise and update Vice President-Litigation on investigations.
Education & Requirements
10+ years of experience in Litigation
Juris Doctorate from accredited Law School
Active lawyer license
Experience in Healthcare industry and with working in a Law firm
Subject matter expert in the area of litigation, arbitration and/or government investigations
Working knowledge of healthcare industry
Strong written and oral communication skills
Strong interpersonal skills
· Strong personal and professional judgment
· Proficiency in Microsoft Word, proficiency or aptitude for learning PowerPoint, spreadsheet programs (Excel) and litigation computerized database.
