Overview (Relocation assistance provided or Remote Position Possible) The TMX Finance® Family of Companies (the "Company") is currently seeking an in-house Lead Litigation Counsel, Arbitration ("Arbitration Counsel") whose primary responsibility is to aggressively defend the Company in Arbitration proceedings. This role naturally requires the Arbitration Counsel to handle the preparation, filings, and attendance of all arbitration hearings and proceedings, including drafting motions, filings, briefings, taking and defending depositions, preparing and presenting witnesses, and cross-examining opposing witnesses. This person will secondarily assist with other legal tasks including pre-suit and litigation matters, regulatory responses, and, as needed, ad hoc projects such as legal research, and contract review. Reporting to the SVP & General Counsel, the Arbitration Counsel will work with a talented and sophisticated group of legal professionals to perform these job duties. As a successful candidate, you will use your persuasive talents, strong attention to detail, and the ability to prioritize deadlines to execute multiple legal tasks, drive strategic and aggressive arbitration and litigation strategies, and consider business impacts when handling all legal matters. You are self-motivated and work well under pressure, like litigating but want to work for one client - the business - in house and you work both independently and as part of a collaborative team. Some travel (domestic) may be required. The position is based in Savannah, GA. Relocation assistance is available or a remote position will be considered for the right candidate. Essential Responsibilities Manage all aspects of certain arbitration matters including coordinating, directing and driving a unified, sophisticated, and complex case strategy, drafting/editing pleadings, discovery, performing legal research, preparing for and attending all arbitration hearings/proceedings, and if appropriate, negotiating settlements. Represent the Company in hearings, depositions, final arbitration hearings as a first chair attorney. Execute all discovery related to arbitration matters including interviewing and preparing witnesses to give testimony, defending Company representatives, noticing and taking depositions of opposing witnesses, and all forms of written discovery in line with the unified and strategic direction of the actions. Direct and work directly with outside counsel on complex legal matters and drive case strategy while managing the associated spend and ensuring costs stay within budget and find creative ways to cut costs. Align arbitration proceedings' case strategies with business objectives to ensure case resolution aligns with business needs and maintain consistency in litigation across the Company's footprint. Partner with members of the Legal team in administration of high volume arbitrations, litigation, and corporate matters, discovery projects, document review, and legal research on a variety of issues, including compliance and regulatory matters. Collaborate with a team of sophisticated legal and business minds when responding to pre-suit matters, including attorney letters and customer complaints, and ensuring arbitration strategies are in line with other litigation matters. Coordinate the development of policies and procedures to mitigate corporate risk identified in defending arbitration matters and engage appropriate business units when necessary. Identify areas for opportunities and productive ways to solve issues before the happen or so they do not happen again. Support the SVP & General Counsel, Vice President - Senior Managing Counsel and the Vice President of Strategic Legal Operations, as needed. Review of insurance policies and/or business/commercial contracts, particularly vendor contracts not only for contract specific terms, but also ensuring terms are aligned with business objectives, as needed. Minimum Qualifications Minimum 4 to 6 years of litigation experience (outlining and drafting motions, preparing for, taking, and defending depositions, handling evidentiary hearings, including final arbitration hearings) required Membership in good standing in at least one state bar in U.S. required (GA preferred) Ability to pro hac vice into various jurisdictions Thorough understanding of the evidence code Proficient with legal research databases, such as Westlaw Ability to research in a thorough and effective manner Impeccable, clear, and concise persuasive communication, both written and verbal, required Strong attention to detail Strong factual and legal analytical abilities Ability to interact effectively with individuals of varied backgrounds and skill levels Comfortable with aggressive and proactive legal strategies Ability to maintain positive attitude in the face of adversity Ability to maintain confidentiality Must be proficient in Microsoft Office Suite and be computer literate Work in a collegial, fast paced, environment Willing to learn and grow by being a self-starter and accepting constructive feedback from anyone who offers such feedback Desire to be part of a fun loving, hardworking, fast paced team of legal professionals who enjoy working with each other Physical demands for this position frequently include: the ability to remain in a stationary position, move about freely inside and occasionally outside of the office, and the operation of mechanical controls, such as a keyboard.
