POSITION TITLE: Senior Deputy Attorney General

DUTY STATION: Carson City, Nevada

Salary: SR. DAG - $108,492.48 - $120,344.00 (Employer/Employee Paid)

SR. DAG - $94,419.36 - $104,761.00 (Employee Paid)

DUTY STATION AND HOURS: The position will be filled in Carson City. The hours

will generally be Monday through Friday, 8:00 a.m. to 5:00 p.m., although travel and

overnight stay may be required for conferences, working groups, discovery, hearings, tri-

al preparation, and hearings or trials outside the Carson City area. This also may include

remote appearances or meetings.

POSITION STATUS: Exempt (FLSA); serves at the will of the Attorney General; em-

ployment with the Attorney General's office is contingent upon completion of

NCIC/NCJIS, and a fingerprint criminal history check.

POSITION SUMMARY: This full-time Senior Deputy Attorney General position will

represent the Division of Health Care Financing and Policy (Medicaid). The position

handles general counsel activities for Nevada Medicaid, including open meetings for

boards/commissions, contracts, Medicaid Estate Recovery (real property liens, probates,

and other recovery activities including subrogation), regulatory activities and rulemaking,

administrative matters related to recipients and/or providers, compliance with state and

federal law related to the provision of services and oversight of providers. This position

may represent other agencies within the Department of Health and Human Services as

needed.

POSITION CHARACTERISTICS: The person chosen for this position will have ex-

cellent legal research and writing skills, a fully developed public speaking ability,

knowledge of state and federal law regarding contracts, administrative proceedings, ap-

peals, and litigation. The person chosen will work closely with the client to maintain,

establish, and modify procedures and policies in compliance with state and federal law.

Representation includes litigation, appellate work and court appearances either remote or

in person. The deputy must be willing and able to work collaboratively with other depu-

ties as Health and Human Services matters may involve other Divisions represented by

colleagues in the office.

Qualifications

KNOWLEDGE REQUIRED: The position requires a willingness to develop

knowledge of substantive law pertaining to state and federal Medicaid law and other

Health and Human Services agencies, as well as civil procedure and evidence in state and

federal courts, at the trial and appellate levels in addition to administrative proceedings.

This position does not include representation of human resources related topics but does

require a working knowledge of probate law, administrative law, and regulatory and leg-

islative frameworks surrounding the payment of providers for services rendered to Neva-

da Medicaid recipients, including but not limited to NRS 422 and related chapters as well

as the Nevada Medicaid Operations Manual, Nevada Medicaid Services Manual, and the

Nevada Administrative Code. Computer usage skill for research (Westlaw), document

preparation, remote access to virtual meetings and client communication, and timekeep-

ing is required. The position further requires knowledge of the rules and cannons of eth-

ics applicable to the practice of law.

Skills Required: Applicants must possess skill in effective written and verbal

communication; presentation of administrative and judicial cases; effective appellate ad-

vocacy; analysis of complex legal problems as well as the ability to apply legal principles

to resolve problems and issues. Applicants must be highly professional, well-organized,

self-motivated, and able to manage their time and obligations. Applicants must have

strong interpersonal and people skills and be able to effectively handle a wide range of

diverse personalities, attitudes, and styles, including interactions with members of the

public.

PHYSICAL DEMANDS: This position requires mobility to work in a typical office

setting and use standard office equipment, including computers at the office and remote-

ly. It may require travel to courts in various parts of Nevada. It also requires vision to

read printed materials and a computer screen; and hearing and speech to communicate in

a clear and understandable manner, and to hear and respond to communications in an un-

derstandable manner. Accommodations may be made for some of these physical de-

mands for otherwise qualified individuals who require and request such accommodations.

MINIMUM EDUCATION AND EXPERIENCE: Applicants must have attended and

graduated from an accredited law school and be admitted to a State Bar in the United

States. They must possess a certificate of admission to the Bar of the State of Nevada

within two years of joining the Office and be eligible to practice law before the courts of

the State of Nevada and the federal district and appellate courts. Experience in both civil

or criminal law will be considered, and candidates should have a working knowledge of

Nevada statutes, rules of evidence, local court rules, and administrative as well as appel-

late procedures. Candidates ready and willing to learn new skills or areas of law are wel-

come to highlight their ability to adapt and research areas of law that may be newer to

them.
