Duties

The Clean Energy Counsel is a key member of the Chief Counsel executive staff and serves as a principal advisor to the Internal Revenue Service (IRS) and the Chief Counsel on all matters relating to a broad array of tax administration activities and priorities associated with the implementation of the Inflation Reduction Act of 2022 (IRA 22) as it pertains to clean energy. The incumbent is the primary legal advisor on clean energy tax credits, incentives, and compliance for the IRS and the Treasury Department and, working with others, is responsible for leading the development and delivery of all published guidance, legal advice, and litigation support. The incumbent leads and directs the efforts of assigned staff and oversees the coordination of special projects and initiatives of the Chief Counsel Deputies. Provides executive level leadership in directing such projects, ensuring successful development and implementation.

The incumbent works closely with IRS Division Commissioners, Treasury officials, Chief Counsel Associate and Division Counsel, and external stakeholders e.g., Department of Energy, and the Environmental Protection Agency, on program matters to include identifying and prioritizing emerging issues; and Department of Justice officials, on matters involving tax litigation.

Major Duties And Responsibilities Include But Not Limited To:


  • Provides executive leadership and oversight for the planning, organizing, and directing of the Office of Chief Counsel's implementation of clean energy tax credits, incentives, and compliance programs.
  • Advises and provides oversight and direction of legal and management support that the Office of Chief Counsel provides to the Internal Revenue Service as it pertains to clean energy tax administration initiatives.
  • Serves as the primary point of contact on matters and issues related to Counsel's part in supporting the IRS's role in the implementation and monitoring of clean energy tax administration programs. Serves as primary liaison to Division and Associate Chief Counsel offices in the coordination and direction of activities to support IRS needs and objectives.
  • Coordinates closely with the Associate Chief Counsel for Passthroughs and Special Industries, IRS officials and officials in the Office of Tax Policy on the implementation of the clean energy provisions in IRA 22.
  • Serves as the Chief Counsel's principal representative in working to institutionalize the Chief Counsel's role in clean energy tax administration initiatives.
  • Advises the Chief Counsel on IRS short and long range program objectives, and the legal services needed to support them. Makes recommendations to the Chief Counsel on staffing and other resource allocations. Keeps the Chief Counsel, the Deputy Chief Counsels, and other Counsel executives apprised of emerging trends and issues.
  • Identifies emerging issues in clean energy tax administration to improve delivery of legal services. Ensures all aspects of the program's functions are managed in a manner that is responsive to the needs of all services supported by the Clean Energy Counsel Office.
  • Personally, represents the Chief Counsel or Deputy Chief Counsel (Technical) at top level IRS and Treasury Department meetings, including policy discussions with executives from other federal agencies. Similarly, represents the Chief Counsel or Deputy Chief Counsel (Technical) in meetings with Congressional staff and at conferences.
  • Coordinates the participation of the Office of Chief Counsel in the development of reports and studies for use by Treasury and/or Congress. As requested, assists in the preparation and drafting of testimony for Congressional hearings, and prepares responses to ad hoc request from Congress and related legislative agencies (e.g., GAO, OMB, etc.).

Qualifications

To qualify for this position of Clean Energy Counsel, Office of Chief Counsel you must meet the following requirements:

  • Possess at least the first professional law degree (LL.B. or J.D.) from a law school accredited by the American Bar Association; AND
  • Applicants must be an active member in good standing of the bar of a State, U.S. Commonwealth, U.S. territory, the District of Columbia, or the Commonwealth of Puerto Rico;
  • Desired Education/Experience: An LL.M. in Taxation is desired but not required. 7 years of professional legal tax experience is desired.

As a Basic Requirement For Entry Into The SES, Applicants Must Provide Evidence Of Progressively Responsible Leadership Experience That Is Indicative Of Senior Executive Level Managerial Capability And Directly Related To The Skills And Abilities Outlined Under Technical Qualifications And Executive Core Qualifications. Typically, Experience Of This Nature Will Have Been Gained At Or Above The GS-15 Grade Level Or Its Equivalent In Federal Service. Applicants Must Possess The Following Technical And Executive Core Qualifications:

You must submit a separate narrative statement that addresses each of the Mandatory Technical Qualifications (MTQs) related to this position as well as the Executive Core Qualifications (ECQs) related to all positions in the Senior Executive Service.

Your narrative statements should include examples of experience, education, and accomplishments applicable to the qualification. Structure your statements in terms of the action taken, the context or environment in which the action was taken, and the outcome or results from such actions. You should write each statement with the vacancy in mind as all qualifications are directly related to the position being filled.

If you do not submit a separate statement addressing the ECQs and MTQs, you will not receive consideration for the position.

  • Executive Core Qualifications (ECQs):

Unless you are currently serving under a Career Senior Executive Service (SES) appointment, or eligible for reinstatement into the SES, you must address the ECQs. Applicants must provide a narrative statement (not to exceed a total of 10 pages) that clearly documents and demonstrates possession of the competencies in the Executive Core Qualifications (ECQs) as established by the U.S. Office of Personnel Management. The following five ECQs provide the focus for certification of executive core qualifications for initial career appointment to the Senior Executive Service.

Building Coalitions - Ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals.   • Mandatory Technical Competencies (MTQs):

In addition to the Executive Core Qualifications, all candidates must show evidence of the following mandatory technical competencies in order to meet basic qualifications for this position. The narrative statements should demonstrate your specialized knowledge and technical competence. Please give concrete examples of your experience and demonstrate the complexity of the knowledge and skills you possess. You should address each MTQ separately, with the total narrative not exceeding ten pages.

Mandatory

In Addition To The General Managerial Competencies Set Out In The Executive Core Qualifications, The Following Mandatory Technical Qualifications Are Specific Competencies Required To Qualify For The Position:

  • Position requires comprehensive, professional knowledge of and experience in applying tax laws (i.e., tax consequences of transactions involving clean energy tax credits, incentives, and compliance).
  • Must have demonstrated experience in successfully managing all aspects of a large-scale law program that involves significant human and fiscal resources. Experience includes planning, directing, budgeting for, staffing, and evaluating such programs, as well as effectively managing equal employment opportunity initiatives.
  • Must have demonstrated the ability to review and evaluate programs for the purpose of assessing their effectiveness against overall organizational goals and objectives, and the ability to design and implement program improvements as necessary to enhance organizational performance.
  • Must have demonstrated the capacity for effective and decisive decision-making, as well as the ability to listen effectively to competing concerns and solve problems of substantial impact, sensitivity, and complexity.

Desirable

  • A thorough understanding of the operations and organization of the Internal Revenue Service and Office of Chief Counsel, and a solid understanding of the Department of the Treasury and its Office of General Counsel, are desirable.
