Description

he Massachusetts Department of Public Utilities (DPU) is responsible for regulatory oversight of investor-owned electric, natural gas, and water utilities in the Commonwealth. In coordination with the Energy Facilities Siting Board (EFSB), the DPU and the EFSB jointly oversee the siting of major energy facilities in the Commonwealth to ensure a reliable supply of energy, with a minimum impact on the environment, at the lowest possible cost. The Siting Division of the DPU supports the review and adjudication of energy facility proposals requiring EFSB/DPU regulatory approvals by conducting comprehensive environmental, technical, economic, and legal reviews, consistent with applicable statutes, regulations and precedent.

The Pipeline Safety Division (“Division”) holds a Certificate of authority for the transportation of natural gas and steam in Massachusetts. The Department of Public Utilities is seeking applicants for the position of Assistant General Counsel- Pipeline Safety Division.

The primary purpose of the Assistant General Counsel (AGC) is to advise the Director of the Pipeline Safety Division in the enforcement of State and Federal laws and regulations pertaining to the operation and maintenance of intrastate natural gas pipelines within Massachusetts, meter testing and steam generation.In addition, the AGC advises the Director and staff, makes recommendations regarding State and Federal legislative proposals, rulemakings, and policy initiatives pertaining to the natural gas industry and steam generation.The AGC is responsible for ensuring the Division is well represented internally and externally, through communications, meetings, and trainings.AGC will participate in stakeholder meetings as required by the Director.

Additionally, the AGC has management responsibility for all legal staff andthe inspection, enforcement, and public awareness of the Damage Prevention Program.The AGC oversees a two Division Counsels, The Damage Prevention Program Manager, two Program Coordinators, two Compliance Officers with partial oversight of the auditor.

A cover letter and resume must be submitted as part of the application process and attached “as relevant” to the requisition.

In performing these duties, the AGC must have a working understanding of State and Federal safety standards governing the construction, operation, and maintenance of natural gas pipelines, liquefied natural gas (LNG) plants, propane (LPG) plants, and the state’s damage prevention laws. .In addition, the Assistant General Counsel must have knowledge of utility and administrative law.

Job Description

  • Oversee the Division’s administration and enforcement of the Commonwealth’s Dig Safe Law (prevention of damage to underground utility facilities)
  • Advise the Director in developing recommendations pertaining to legislative proposals, rulemakings, and policy initiatives pertaining to the natural gas industry.
  • Assist with the Department’s management of the pipeline safety program as a certified agent of the U.S. Department of Transportation (DOT).
  • Assist in the Division’s administration and enforcement of the Commonwealth’s natural gas safety code pertaining to the construction, operation, and maintenance of natural gas pipelines, liquefied natural gas (LNG) plants, propane (LPG) plants and meter testing.
  • Assist in the investigation of accidents related to natural gas explosions and fires.
  • Assist in the management of the Division’s program for the periodic testing of gas meters.
  • Assist in the management of the Division’s program for the testing of gas, electric, and water meters based on consumer billing complaints.
  • Assist with the Department’s management of the steam generation safety program.

Requirements

This position requires a JD degree and admission to the MA bar.

This position requires a JD degree and admission to the MA bar.

Applicants must have at least (A) five (5) years of full-time or, equivalent part-time, professional, professional internship, administrative, supervisory, or managerial experience in business administration, business management, public administration, public management, clinical administration or clinical management or (B) any equivalent combination of the required experience and substitutions below.

Substitutions

I. A certificate in a relevant or related field may be substituted for one (1) year of the required experience.

II. A Bachelor’s degree in a related field may be substituted for two (2) years of the required experience.

III. A Graduate degree in a related field may be substituted for three (3) years of the required experience.

IV. A Doctorate degree in a related field may be substituted for four (4) years of the required experience.
