The bar exam has seen a significant slump in pass rates over the past two years. However, early data from the February 2024 bar exam suggests a promising turnaround.

The Slump and Its Causes

The bar exam pass rates have been on a downward trend for several years. The overall pass rate for the February 2022 exam was 45%, while the July 2022 exam saw a slightly better pass rate of 64%. This slump was largely attributed to the volatility caused by the COVID-19 pandemic.

The February bar exam traditionally sees lower pass rates than the July exam, primarily because examinees do not answer as many questions correctly on the Multistate Bar Examination (MBE) compared with those who take the exam in July.

Signs of Recovery

The National Conference of Bar Examiners (NCBE) announced that the national mean scaled score for the February 2024 Multistate Bar Examination (MBE) was 131.8, an increase of more than 0.6 points compared to the February 2023 mean of 131.1. This suggests that pass rates have increased, indicating a stabilization of the attorney licensing test after several years of volatility.

The increase in the MBE mean score is particularly significant given that the MBE is one of the three sections that make up the bar exam in most U.S. jurisdictions.

Looking Ahead

While the early data is promising, it is important to note that many jurisdictions are still in the process of grading the written components of the bar exam. Once this process is completed, bar exam scores will be calculated and passing decisions reported by those jurisdictions.

The increase in the MBE mean score and the expected rise in pass rates are encouraging signs for law graduates. However, it is also crucial to remember that the bar exam is just one step in the journey to becoming a practicing attorney.
