Senior Vice President (SVP), Legal Affairs and General Counsel

This position oversees the Corporate Legal Program within Intermountain Healthcare, and Serves as Chief Legal Officer and in-house legal counsel for Intermountain Health Care, Inc. (IHC) and its subsidiaries and manages Intermountain's legal services and government relations programs and activities for intermountain Healthcare and its subsidiaries. Responsibilities include managing a team of legal professionals, policy development, contract review, advising Senior Management and the Board of Directors on legal matters, etc. and this position will also act as liaison with other functions/departments and with Senior Management to ensure appropriate support, resource allocation, and coordination of legal efforts within Intermountain Healthcare.

  • Develops and coordinates Intermountain healthcare's government relations programs, including the development of Intermountain positions on federal and state legislation and regulations which affect the corporation, and the drafting of regulations favorable to Intermountain. Accurately interprets laws and regulations and develops recommendations for taking advantage of them in ways that are most favorable to Intermountain.

  • Provides legal counsel and government policy direction to Intermountain healthcare, which operates in a rapidly changing and evolving and more complex legal and political environment. Provides independent legal counsel and advice to key Intermountain management on a wide range of corporate legal matters and business activities, such as corporate organization, meetings, bylaws, acquisition of hospitals and other health care facilities, contract negotiations, development of alternative delivery systems such as HMOs and PPOs, strategic business plans, property, income, and sales taxation, antitrust; etc.; exercise independent judgment in the management of such legal matters.

  • Acts as a subject matter expert and resource for others. Stays current on changes in laws and regulations having to do with the health care industry and shares information as appropriate. Communicates effectively with a wide variety of corporate, elective, and regulatory personnel.

  • Prepares legal opinions, positions, testimony, and applications for administrative matters before federal and state agencies, such as the Federal Department of Health and Human Services, the State Department of Health, County Commissions, etc.; areas addressed include, but are not limited to, Medicare and Medicaid reimbursement, licensure, antitrust, certificate of need proceedings, property taxes, and zoning ordinances.

  • Lobbies effectively for Intermountain positions in the face of the many conflicting pressures and priorities with which legislators and government officials have to deal. Represents the corporation before appropriate federal and state legislative and regulatory bodies in order to influence the adoption of positions favorable to Intermountain.

  • Develop key legislative and executive branch contacts at all government levels, including the organization and management of Intermountain Healthcare's Congressional Fellowship Program and Intermountain's legislative conferences on health policy.

  • Supervise and coordinate the legal services of Intermountain Healthcare and its subsidiaries with outside legal counsel. Develops, maintains, and manages Intermountain's legal documents, legislative budgets and programs, and Political Action Committee.

  • Manage subordinates, lobbyists, outside counsel, and other consultants to meet the objectives of IHC and the Legal and Government Relations Department of IHC. Manages a team of legal professionals while being heavily involved personally in legal counsel and government relations assignments. Responsible to oversee staffing, performance management, development, coaching and other administrative roles assigned to those who lead direct reports.



Minimum Qualifications

Must have a Juris Doctor degree from an ABA accredited law school and have a license to practice law in the State of Utah. Education is verified.

Ten years experience with an emphasis in the legal aspects of professional liability, medical malpractice litigation, and/or health facility institutional liability, contract compliance, or employment / business law.

Five years experience in a leadership role, with at least three years in a role supervising other Attorneys / Legal Professionals.
- and -
Significant knowledge of applicable healthcare regulatory requirements is required (Stark, anti-kickback, fraud & abuse, private inurnment).
- and -
A working knowledge of the legal aspects of managed care and health plan administration.
- and -
A working knowledge of medical staff issues, how private and hospital-owned physician practices operate, JCAHO standards, EMTALA and GME issues and managed care.
- and -
Experience in a role requiring excellent written and oral communication skills and be able to collaborate effectively with various stakeholders in the organization (management, senior attorneys, physicians, compliance, hospital administrators, health plan personnel, etc.).
- and -
Experience in a role requiring the ability to work with all levels of management, strong problem solving and influencing skills, demonstrated ability to partner effectively with others in handling complex issues with sound business judgment.
- and -
Experience using word processing, spreadsheet, database, internet and e-mail and scheduling applications.
- and -
Experience in a role requiring effective verbal, written and interpersonal communication skills.
